The burial or interment of deceased persons within the limits of the Borough of Bath be and the same is hereby prohibited, excepting the cemetery or burial ground known as the Green Mount Cemetery, bounded on the north by Northampton Street, on the east by Broadway Street, on the south by Penn (or Cemetery) Street, on the west by land of Joseph A. Horner, containing about eight acres, and the cemetery or burial ground known as the Catholic Cemetery located on Penn Street.

Any person who shall violate any provision of this chapter shall, upon conviction, be sentenced to pay a fine of not more than $600 and costs of prosecution, or, in default of payment of such fine and costs of prosecution, or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days. In addition, court costs and reasonable attorney fees incurred by the Borough in enforcement proceedings shall be assessed against violator and awarded to the Borough.
