A. 
From and after the date of enactment hereof, recycling shall be mandatory. All persons in the Borough shall separate all designated recyclables from all other MSW and riffraff produced at their establishments, shall store such material for collection, and shall place same for collection in accordance with the guidelines established by the contractor with the approval of Borough Council.
B. 
Any person owning or operating a multifamily property shall comply with its recycling responsibilities by establishing its own storage collection system for placement at curbside on designated collection dates. The collection system must include suitable containers for collecting and sorting materials, easily accessible location for the containers, and written instruction to the occupants concerning the use and availability of the collection system.
C. 
Any person occupying commercial, institutional and municipal establishments within the Borough is exempt from the requirements of this article, if those persons have otherwise provided for the recycling of materials they are required by this article to recycle. To be eligible for an exemption under this Subsection C, a commercial or institutional establishment must annually provide written documentation to the Borough of the total number of tons recycled.
Designated recyclables shall consist of those items listed in the definition hereof. The designated list may be amended from time to time by resolution of the Bath Borough Council.
All designated recyclables shall, from time of pickup, become the property of the contractor.
It is the intent of this article that the reasonable accumulation of recyclables of each family for the collection period will be collected for the standard charge established from time to time. The Borough Council may refuse to collect unreasonable amounts or may make any additional charge for excessive amounts stored or placed for collection.
It shall be a violation of this chapter for any person, other than a hauler registered with the Borough as set forth in § 535-12, to collect designated recyclables placed by a person for collection. Each unauthorized collection in violation hereof from one or more residences on one calendar day shall constitute a separate and distinct offense punishable as hereinafter provided.
