Except as provided in this chapter, the keeping, housing, storing
and placing of all junk, such as all scrap iron, wrecked cars, junked
cars, junked machinery, wrecked machinery, junked trailers, wrecked
trailers, bottles, jugs, rags, broken glass, paper of all kinds, all
scrap metal, and anything that might pertain to a junkyard, is declared
a public nuisance, and a detriment to the public health and welfare
of the citizens of the Village of Footville.

No person shall keep, house, store or place in the Village, any junk,
such as all scrap iron, wrecked cars, junked cars, junked machinery,
wrecked machinery, broken glass, junked trailers, wrecked trailers,
bottles, jugs, rags, papers of all kinds, all scrap metals, and anything
that might pertain to a junkyard, unless he conforms to the regulations
of this chapter.

Such person shall secure from the Village Board a license, at the
cost of $300 per year, payable to the Village at the Village Clerk's
office on July 1 of each year.

Such license shall be granted only by 3/4 majority vote of the Village
Board.
D.Â
It shall be the duty of the Village Board to decide where any person
seeking a license to operate a junkyard may have the place of business
located. No license shall be granted to anyone to operate a junkyard
within 1,000 feet of any residence in the Village.

All junkyards shall be completely surrounded by a fence; this
fence to be constructed of wood or metal. This fence shall be perfectly
solid so as to keep all junk from view of any passerby or occupant
of any adjoining property. The fence shall be well constructed, well
painted and maintained in neat appearance. The fence shall have a
minimum height of eight feet.
All dealers of cars, trucks, machinery and trailers, wanting
to keep wrecked cars, junked cars, wrecked trailers, junked trailers,
junked machinery, wrecked machinery, in their possession are classed
as junkyard operators and shall conform to the regulations of this
chapter.

Violations of this chapter shall be subject to the penalties provided in § 1-4, Penalties.
