As used in this chapter, the following terms shall have the
meanings indicated:
CERTIFICATE OF HABITABILITY
A certificate issued by the Construction Code Official, Zoning Officer, Housing Official, or Fire Marshal of the Township, indicating that at the time of its issuance the residential property for which it has been issued complies in all respects with Chapter
390 of the Code of the Township, entitled "Property Maintenance." In addition, the certificate shall indicate that the residential dwelling unit is equipped with one or more smoke-sensitive alarm devices and carbon monoxide sensor detectors, or, at the time of inspection, there was no potential carbon monoxide hazard within the said residential dwelling unit all in accordance with N.J.A.C. 5:70-4.19.
A certificate of habitability shall be required to be obtained by the owner of any residentially occupied real estate prior to the rental or lease or transfer of title of residential property involving a new occupant, a new tenant or a new owner of said property. It shall be the owner's obligation to make application for a certificate of habitability from the appropriate officials and, in that connection, shall pay a fee as provided for in Chapter
235, Fees, of the Code of the Township of Mine Hill in order to obtain the certificate.
