This chapter shall be known as the "Electrical Code of the Village of Oakfield."
Since there is danger to life and property inherent in the use of electrical energy, this Electrical Code in the form of a local law is enacted to regulate the installation or alteration of wiring for electric light, heat or power and signal systems operating on 50 volts or more in or on all real property within the Village of Oakfield.
All electrical installations heretofore mentioned shall be made in conformity with the requirements of the National Electrical Code as compiled in the National Fire Protection Association Pamphlet No. 70, as approved, adopted and from time to time amended by the American Standards Association, except when the provisions of this chapter or any other local law, ordinance or building code of the Village of Oakfield, now existing or hereinafter adopted, shall differently prescribe, in which event compliance with the provisions of this chapter, such other local law, ordinance or building code shall be recognized as proper compliance with this chapter.
The position of Village Electrical Inspector is hereby created. Said position shall be filled by appointment by the Village Board of Trustees, and said appointee shall serve at the pleasure of the Village Board. It shall be the duty of the Village Electrical Inspector to enforce the provisions of this chapter. The Village Electrical Inspector and any inspector of an inspection agency authorized or chartered to do so by the State of New York and hereinafter designated, in writing, by either the Village Electrical Inspector or the Village Board are hereby authorized and appointed as agents of the Village of Oakfield to perform such duties as are hereinafter specified in § 142-5 of this chapter. All costs, if any, incurred in connection with the inspections and reinspections hereinafter authorized shall be borne by the owner or lessee of the property inspected. In no event, however, shall the cost or expense of such inspections and reinspections be a charge against the Village of Oakfield.
Any person, firm or corporation desiring to install or cause to be installed or to alter or cause to be altered electrical wiring for light, heat, power or signal systems operating on 50 volts or more or to connect the same or cause the same to be connected in or on properties within the Village of Oakfield to any source of electrical energy supply shall first make and file an application for either said installations, alteration or connection to the Village Electrical Inspector on forms to be provided by him/her at no cost and available at the offices of either the Village Clerk-Treasurer or the Village Electrical Inspector. Either the Village Electrical Inspector or any inspector duly authorized as an agent of the Village of Oakfield pursuant to this chapter shall have the authority, once an application has been obtained, to make inspections and reinspections of electrical installations, wiring, devices, appliances and equipment on properties within the Village of Oakfield, to approve or disapprove the same, and to issue to the owner and/or lessee of the property inspected appropriate temporary or permanent certificates of compliance or noncompliance depending on whether the electrical installations, wiring, devices, appliances or equipment are in conformity with the standards herein prescribed. It shall be the further duty of all inspectors other than the Village Electrical Inspector to make and deliver written reports of all inspections showing compliances with as well as deviations from or omission of the National Electrical Code and of all local laws, ordinances and building codes, now existing or hereinafter adopted, as referred to in this chapter, to the Village Electrical Inspector. Where an inspection is made by the Village Electrical Inspector, it shall be his duty to make similar written reports and to deliver copies of reports either received by him/her from other inspectors or drawn by him/her individually to the Village Clerk-Treasurer of the Village of Oakfield.
It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed or to alter or cause to be altered electrical wiring for light, heat, power or signal systems operating on 50 volts or more in or on properties in the Village of Oakfield until an application for inspection has been filed with the Village Electrical Inspector. It shall be a violation of this chapter for any person, firm or corporation to connect or cause to be connected electrical wiring in or on properties for light, heat, power or signal systems operating on 50 volts or more to any source of electrical energy supply prior to the issuance of a temporary or permanent certificate of compliance by the Village Electrical Inspector or by one of the inspectors authorized to serve as agents of the Village of Oakfield pursuant to § 142-4 hereof.
Any violation of this chapter shall constitute a violation pursuant to the Penal Law of the State of New York. Each day that said violation continues shall constitute a separate offense. Any person, upon conviction therefor, shall be subject to a fine of not more than $250 or be imprisoned for a period of not more than 15 days, or both, for each offense. This chapter may also be enforced by injunction.
The provisions of this chapter shall not apply to the electrical installations in mines, ships, railway cars, automotive equipment or the installations or equipment employed by a railway, electrical or communication utility in the exercise of its function as a utility and located outdoors or in buildings used exclusively for that purpose. This chapter shall not apply to any work involved in the manufacture, assembly, test or repair of electrical machinery, apparatus, materials and equipment by a person, firm or corporation engaged in electrical manufacturing as their principal business. It shall not apply to any building which is owned or leased in its entirety by the government of the United States or the State of New York.
This chapter shall not be construed to relieve from or lessen the responsibility of any person owning, operating, controlling or installing any electrical wiring, devices, appliances or equipment for loss of life or damage to person or property caused by any defect therein, nor shall the Village of Oakfield, the Village Electrical Inspector or any agent duly appointed pursuant to this chapter be deemed to have assumed any such liability by reason of any inspection made pursuant to this chapter.
If any clause, sentence paragraph, section or part of this chapter shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered.
