A. 
The grades of the streets, alleys and avenues of the City of Waverly, Missouri, shall be established by recording the elevation at the intersections of streets, alleys and avenues in a book to be kept for that purpose, which book shall contain a record of all acts and ordinances of the Board in relation to any way affecting the established grade of any street, alley or avenue.
B. 
All the corners of intersections of streets, embracing the full width of the sidewalk thereof, shall bear a uniform elevation, except when otherwise provided; and whenever it shall be deemed expedient not to bring all the corners at any intersection to the same level, then the elevation of each corner at such intersection shall be given.
C. 
All grades shall extend in unbroken uniformity from intersection to intersection, except when otherwise provided by ordinance, and whenever the grade of any street is broken between intersections, the elevation of such break shall be given, together with the exact distance thereof from one or the other of the relative intersections.
D. 
The permanent benchmark for the grade elevation of the City of Waverly, Missouri, is at the northeast corner of Main and Washington Streets at a point situate two (2) inches south of the north end of and in the center of the length of an east to west horizontal line across the width of the north end of the bend of the lower (first) step of a concrete sidewalk stairs leading up to the theater at the northeast corner of Washington Street and Main Street. Elevation is four hundred nine and thirty-four hundredths (409.34) feet.
E. 
All grade elevations shall be recorded in figures, designating the whole number of feet and tenths and hundredths of a foot, which manner of designating the elevations of the City shall be used in all returns, certificates and other papers, or acts relating to the grade of any street, alley or avenue in the City of Waverly, Missouri.
F. 
The book in which the record is kept, as required in Subsection (A) of this Section, shall be labeled "City Grade Book." The City Clerk shall be the lawful custodian thereof and it shall be his/her duty to enter therein all record-matter required by this Section, and said book shall be a public record.
G. 
The City Engineer, or any person acting as such by order of the Board, shall make returns to the Board of all work ordered to be done by him/her, certifying to the correctness of the same, and he/she shall designate, in such returns and certificate, the bench from which he/she started, and after such certificate and returns have been passed upon by the Board, the same shall be recorded, in connection with all record-matter referred to in the return in the City grade book.
H. 
All elevations of grades shall be established from said benchmark regulating the grade datum of the City, and no other benchmark shall be used, unless it shall have been permanently located and established from the datum bench and its locality, description and elevation be found recorded in the City grade book.
I. 
The grade of any street, alley or avenue, the grading of which has heretobefore been performed under the supervision and direction of any authorized City officer shall be and remain according to such grading, until a public necessity demands that the same be altered.

A. 
The City of Waverly has adopted these regulations for the installation of curb and guttering to be done on the City streets, and may set a budget each year for same. Budget will vary depending upon funds available for that year.
B. 
Any owner desiring curb and guttering along their properties shall be required to fill out a formal request form at City Hall during the regular work hours. The owner will be required to read and understand the regulations and specifications before signing the request forms.
C. 
The Street Superintendent or Commissioner shall inspect the area and set guidelines for said work to be performed.
D. 
Contractors wishing to bid this work shall contact the Street Superintendent or Commissioner who will accompany the contractor to the job site with a set of specifications to insure all parties were in agreement before a formal bid can be made.
E. 
No curb and guttering will be allowed without Board approval.
F. 
No curb and guttering will be allowed in City-owned alleys.
G. 
Any owner may be denied a request to install curb and guttering if it is determined by the Street Superintendent or Commissioner to cause extreme erosion in street drain ditches or on another owner's properties. However, if the other owners request curb and guttering, then the request may be approved for all owners.
H. 
Where the owner's properties stop at a City-owned alley, then the owner shall be required to turn the curb and gutter into the alley with a radius of no more than three (3) feet and the back of the curb shall be set adjacent to and against owner's property, and shall not extend into the alley entrance more than six (6) feet beyond the end of radius. At the time of construction, the City may elect to install a valley across the alley to prevent erosion, and will pay for the valley only, one hundred percent (100%) of the total cost.
I. 
If for any reason an owner has to remove any part of the curb and guttering, then they shall be required to obtain a permit at City Hall. The curb and gutter must be saw cut to remove any part of same. After work is completed, the curb and gutter must be reinstalled according to Subsection (C) of this Section. Curb and gutter shall be replaced within a thirty-day period after work is complete.
J. 
After the time period has passed, the City has the right to make necessary repairs, by any means, and will bill the owner. The owner will have thirty (30) days after billing to pay this cost. After the thirty (30) days have passed and no payment has been made, the City may impose a fine of five dollars ($5.00) per day until this bill is paid.
K. 
Backfilling on the street side will be done according to the following specification: the City has the right to do necessary backfilling, and to furnish materials for the same.
L. 
All curb and guttering will be installed according to City specifications. (See attachment).[1]

A. 
The City of Waverly has set forth these specifications and guidelines for the purpose of digging or cutting into the City streets and alleys. The City will not be held liable for any type of accident caused by contractors, laborers and equipment to underground lines of any type or damages to personal properties.
B. 
Before any work can be performed on City-owned properties, a permit must be obtained and a deposit in the amount of three hundred fifty dollars ($350.00) shall be paid to the City of Waverly at City Hall during regular working hours. The Street or Water Department must be notified.
1. 
Contractor must contact DIGRITE for line locates of all underground lines and buried cables.
2. 
The street shall be saw cut through the pavement where the digging is to be done, and will be cut into pieces approximately two (2) feet long and laid aside. After all work and backfilling is complete, the paving parts shall be set back in place and flush with the original pavement.
3. 
Traffic cones or barricades must be placed around work areas for the safety of workmen and equipment. If for any reason a ditch or hole must be left open overnight, the barricades or cones must be equipped with either flashers or reflectors. City-owned cones and barricades may be used. Should any loss occur, the owner shall replace or reimburse the City for the equipment.
4. 
Any ditch or hole in the City street over four (4) feet deep may be backfilled with well-tamped dirt up to four (4) feet from the top of the opening. Sand or rock, not to exceed three (3) inches in diameter, shall be used up to the bottom edge of the pavement. The pavement pieces which were cut out shall be relayed over the backfilled area. All excess debris must be removed and hauled to the Street Department and dumped into a designated area.
5. 
If for any reason an owner has this work done without obtaining a permit and paying the deposit, the City may assess a fee of ten dollars ($10.00) per day and City utilities may be stopped until the full payment of all debts to the City is satisfied.
6. 
In the event of an emergency at night, holidays or weekends, then the owner shall be required to pay the deposit within five (5) working days. If this is not done, then all of Subsection (B)(65) will be enforced.
7. 
A copy of these specifications will be given to the person obtaining a permit. It will be the owner's responsibility to insure the specifications are followed. If work is not completed to specifications, Subsection (B)(5) will be enforced.
C. 
The Water or Street Department will inspect the finished project and, upon approval of the Board of Aldermen, a refund of up to one hundred fifty dollars ($150.00) may be given.
