No individual, partnership, corporation or other entity shall
construct, modify or improve the water system servicing the City of
Leadington, including, but not limited to, pump stations, water lines
and all facilities and appurtenances thereto, without securing the
prior written approval from the City of Leadington; provided, however,
that such approval shall not be required with respect to routine maintenance
and repair of ordinary wear and tear to the existing water system,
facilities and appurtenances.

Written approval from the City of Leadington must be obtained
by first submitting written application to the City Clerk. The Board
of Aldermen shall thereupon consider such application and, if approved,
shall by resolution authorize the Mayor to notify the applicant, in
writing, of the Board's approval of such construction, modification
or improvements as are specifically described in said notice. Applicant
shall thereupon be authorized to proceed with the work described in
such notice.

Any individual, partnership, corporation or other entity which
shall fail to obtain such approval or shall engage in any work beyond
the scope of the City's notice to proceed shall be subject to a fine
not to exceed one hundred dollars ($100.00) per day for each day such
individual, partnership, corporation or other entity shall remain
in violation of this Chapter, and shall further be subject to any
civil liabilities, damages, penalties, and injunctive relief as the
City may prosecute for the purpose of remedying any such violation.
