A. 
All appointments to or promotions within the Police Department shall be made by the Chief of Police with and subject to the approval of the Board of Aldermen. The Chief of Police shall report to the Mayor and the Board of Aldermen.
B. 
The Chief of Police shall be under the direction and supervision of the City Administrator who shall be responsible for performing periodic performance reviews.

The Chief of Police shall serve at the pleasure of the Board of Aldermen. The Chief of Police may be removed from office in the manner described in Section 106.273, RSMo.

Except as is provided for in this Article, no elected official, appointed official or City employee shall directly or indirectly interfere with the conduct of the duties of the Chief of Police or any employees subordinate to the Chief of Police in the conduct of their duties.

The Chief of Police shall be the head of the department and have supervision over all members thereof.

The Chief of Police shall keep such records and make such reports concerning the activities of his/her department as may be required by Statute, the Municipal Code of the City of Lake Ozark, the Mayor or the Board of Aldermen. The Chief shall be responsible for the performance by the Police Department of its functions, and all persons who are members of the Police Department shall serve subject to the order of the Chief of Police.

The Chief of Police may make or prescribe such rules and regulations as he/she shall deem advisable. Such rules, when approved by the Board of Aldermen, shall be binding on all persons who are members of the Police Department. Such rules and regulations may cover, besides the conduct of the members, uniforms and equipment to be worn or carried, hours of service, vacations and all other similar matters necessary or desirable for the better efficiency of the Police Department.

The Chief of Police shall have the custody of all lost, stolen or abandoned property recovered in the City.

It shall be the duty of the members of the Police Department to see to the enforcement of all of the ordinances of the City and all Statutes applicable therein; and to preserve order and prevent infractions of the law and arrest violators thereof.

It shall be the duty of every member of the Police Department to conduct himself/herself in a proper and law abiding manner at all times and to avoid the use of unnecessary force. Each member of the Department shall obey the order and directions of his/her superior and follow the guidelines established by the Department Policy Manual which shall be attached to and become part of the Personnel Manual for all Police Officers of the City of Lake Ozark, Missouri. All Officers are expected to follow the work schedule and more than one (1) shift change in the monthly schedule shall be done by written approval of the Chief of Police.

Every member of the Police Department shall appear as witnesses whenever this is necessary in a prosecution for violation of any ordinance or of any State or Federal law. No such members shall retain any witness fee for service as a witness in any action or suit to which the City is a party; any fees paid for such services shall be turned over to the Chief of Police who shall deposit the same with the City Collector.

The Chief of Police is authorized to establish a reserve force for extra help as needed and authorized. Compensation shall be at a rate determined by the Board of Aldermen. All special Reserve Officers shall be certified according to the State requirements for minimum standards of Police Officers and shall not carry firearms unless they are certified and qualified to do so.
