[Ord. No. 2018-4, 3/19/2018]
Property owners are responsible for the costs of sidewalks and
curbs damaged by existing street trees. Sidewalks and curbs shall
be repaired by the property owner according to Borough ordinances,
and sidewalks shall accommodate the existing street trees, their roots,
and future growth needs.
[Ord. No. 2018-4, 3/19/2018]
The Borough, when removing a street tree for any reason, will
restore the adjacent sidewalk as necessary at Borough expense. As
a matter of standard practice, the stump will be reduced and ground
down as flush with existing grade as possible. Any sidewalk repairs
thereafter due to settlement from the decay of the residual stump
and roots are the maintenance responsibility of the adjacent property
owner.
[Ord. No. 2018-4, 3/19/2018]
Any person, firm or corporation who shall violate any provision
of this ordinance shall be guilty of a summary offense and upon conviction
be sentenced to pay a fine of $600 plus costs of prosecution. This
shall be enforced by the Borough Manager and his/her duly authorized
representatives.
