The Borough of Lemoyne hereby establishes a commission to be known as the "Shade Tree Commission," which Commission shall consist of three members appointed for terms initially of one commissioner for three years, one commissioner for a term of four years and one for a term of five years; on the expiration of the term of any commissioner, Council shall appoint a successor to serve for a term of five years; vacancies in the office of Commissioner shall be filed by Council for the unexpired term.
The Commission shall have exclusive custody and control of the shade trees in the Borough, and is authorized to plant, remove, maintain and protect shade trees on the streets and highways in the Borough [see Chapter 499].
The Commission shall recommend to Council regulations for the care and protection of the shade trees in the Borough on the streets, highways and the parks thereof, but no such regulations shall be in force until approved by Council and enacted as an ordinance.
The members of the Commission shall serve without compensation.[1]

The Shade Tree Commission created hereunder shall assume their duties and obligations on the date of the enactment of this chapter and the Commission shall thereupon be in full force and effect.
