The provisions of this Chapter shall apply only to those lands which are within the corporate limits of Kingdom City and which are also identified as unnumbered A zones on the Flood Hazard Boundary Map (FHBM) or Flood Insurance Rate Map (FIRM) Callaway County Panel 29027C02000, effective date February 18, 2005, as amended, and any future revisions thereto. In all areas covered by this Chapter, no development shall be permitted except after the issuance of a floodplain development permit, granted by the Board of Trustees or its duly designated representative. No permit shall be granted for any construction that does not fully comply with this Chapters, and specifically with Article
III thereof.

The Utilities Superintendent is hereby designated as the Floodplain
Administrator under this Chapter.

No development located within the special flood hazard areas
of Kingdom City shall be located, extended, converted, or structurally
altered without full compliance with the terms of this Chapter and
other applicable regulations.

It is not intended by this Chapter to repeal, abrogate, or impair
any existing easement, covenant or deed restriction. However, where
this Chapter imposes greater restrictions, the provisions of this
Chapter shall prevail. Any Village ordinances which are inconsistent
with this Chapter are hereby repealed to the extent of the inconsistency
only.

In interpreting and applying this Chapter, this Chapter shall
be construed as setting forth the minimum requirements for construction
within the special flood hazard area, and shall be interpreted so
that each provision harmonizes with all others, and with all regulations
established pursuant to the National Flood Insurance Program.

The degree of flood protection required by this Chapter is considered
what is reasonable for regulatory purposes and is based upon engineering
and scientific study by the Federal Government. Larger floods may
occur on occasion, or the actual flood heights may be increased by
man-made or natural causes (such as ice jams and bridge openings restricted
by debris). This Chapter should not be considered as providing any
guarantee that areas outside unnumbered A zones will be free from
flooding or flood damage. Nor shall this Chapter be considered as
providing any guarantee that any construction undertaken within a
flood area in conformity with this Chapter will be protected from
damage. This Chapter does not create any liability on the part of
Kingdom City, or any officer or employee thereof, for any flood damage
that may result from reliance on this Chapter or any administrative
decision made thereunder.

If any Section, clause, provision, or portion of this Chapter
is adjudged unconstitutional or invalid by a court of appropriate
jurisdiction, the remainder of this Chapter shall not be affected
thereby.
