The president shall, by and with the consent of the council, appoint a Village Attorney who shall advise the president and trustees in all legal matters pertaining to the Village and shall represent the Village in all suits and legal proceedings in which the Village is a party.

(a)ย 
Designated. The Village Manager is hereby designated as the Village investment officer in conjunction with the Village Clerk and the Village streets administrator for state department of transportation purposes.
(b)ย 
Responsiblities; duties; authority. The position of Village Manager shall have the following responsibilities, duties, and authority:
(1)ย 
To organize, plan, and supervise all Village operations in accordance with directions and policies established by the Village Council. Said responsibilities shall include supervision and operation of the streets, parks, and office departments and all Village personnel and employees and the training, evaluation, and disciplining of all Village personnel.
(2)ย 
To administer all contracts and professional services authorized by the Village Council.
(3)ย 
To supervise and oversee all financial aspects of the Village in accordance with directions and policies established by the Village Council including the following:
a.ย 
Budgeting;
b.ย 
Long range planning;
c.ย 
Capital improvements; and
d.ย 
Purchasing.
(4)ย 
To perform all duties of investment officer of the Village in accordance with Public Act No. 20 of 1943 (MCL 129.91 et seq.), the Michigan Investment Act for Local Units of Government, and the resolution of investment policy adopted by the Village Council.

(a)ย 
As authorized by Section 1(3), chapter II of Public Act No. 3 of 1895 (MCL 62.1), the Village Clerk shall be chosen by nomination by the Village President and appointment by a majority vote of the Village Council.
(b)ย 
The term of office of the Village Clerk shall be two years from the date of appointment and until a successor is appointed. The person first appointed as Village Clerk under this section shall have an initial term of office commencing as of the date such person takes and subscribes the oath of office and files it with the Village Clerk, together with the filing of any bond required by law.

(a)ย 
The treasurer of the Village shall be nominated by the president and appointed by the council upon a vote of two-thirds of the members of the Village Council.
(b)ย 
The treasurer initially appointed under this section shall serve until March, 2002.
(c)ย 
Thereafter, the term of office for the treasurer shall be for two years.
(d)ย 
Vacancies to the treasurer's position shall be filled by nomination by the president and appointed by the council by a vote of two-thirds of the members.
(e)ย 
The treasurer shall serve at the will of the council and may be terminated with or without cause and with or without notice.

The powers and duties of the treasurer shall be prescribed by the council.

The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
ESPOUSED RELATIONSHIP
Means a situation involving two or more people living together, sharing bed and board, without the benefit of a marriage license or marriage ceremony.
IMMEDIATE FAMILY
Means those persons within the second degree of consanguinity of affinity (mother, father, sister, brother, spouse, child, grandparent, grandchild, parent-in-law, daughter-in-law, son-in-law, brother-in-law, sister-in-law) and those persons sharing an espoused relationship.
OFFICIAL
Means any person elected to, appointed to, or employed in the following positions: member of the Village Council, Village Manager, clerk, treasurer, attorney, electrical or building inspector and department of public works.

The appointment or employment of members of an immediate family shall not be allowed within the same department or in a supervisor/subordinate relationship where the chain of command crosses departmental lines. In the event employees become members of an immediate family by the process of adoption or marriage, or creation of espoused relationship, reasonable effort shall be made to place one of the employees in another department or outside the chain of command; provided, that a position is available wherein the duties and rate of pay are reasonable similar to the position from which the employee is being transferred.

The appointment or employment of members of the immediate family of any Village official shall be prohibited.

This division shall not prohibit members of an immediate family of any Village official to work as election workers for the Village except when a member of the immediate family is running for Village or township public office.

An official charged with conduct constituting a violation of this division shall be entitled to a public hearing on demand by the official charged, and notice of such hearing shall be published in one or more newspapers of general circulation in the Village at least one week in advance of the hearing. The Village Council shall be the judge of any violations of this division and may, upon a finding of violation, declare, in the case of a councilmember, forfeiture of his office, and in the case of all other officials, may discharge such officials from Village employment. The council may take such other less stringent remedial action as may be necessary to secure the best interest of the Village.
