Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of Public Act No. 230 of 1972 [MCL 125.1508b(6)], the Building Official of the Village is hereby designated as the enforcing agency to discharge the responsibility of the Village under such Act. The Village assumes responsibility for the administration and enforcement of said Act throughout its corporate limits.

Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of Public Act No. 230 of 1972 [MCL 125.1508b(6)], Appendix G of the state construction code shall be enforced by the enforcing agency within the Village.

The Federal Emergency Management Agency (FEMA) Flood Insurance Study (FIS) entitled "Berrien County, Michigan and incorporated areas" and dated April 17, 2006, and the Flood Insurance Rate Map (FIRM) panel number: 260210093C and 260210094C and dated April 17, 2006 are adopted by reference and declared to be a part of Section 1612.3 of the state construction code.

Before a building permit is authorized in the Village for other than single-family or duplex dwelling construction, a permit from the road commission responsible for ingress and egress, if the ingress and egress is to be altered or established, shall first be obtained by the builder. Builders shall be required to preserve the construction ditch along the road right-of-way and tubes shall be installed along driveways, where it is determined that the driveways are needed, at the time of construction.

Permit fee schedules for the state construction code shall be as currently established or as hereafter adopted by resolution of the Village Council from time to time.
