The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
BUILDING
Means any structure, framework or housing, public or private, and includes tanks, receptacles and containers for the storage of commodities or other materials.
FIRE CHIEF
Means the chief of the Lincoln Charter Township Fire Department.
FIRE HAZARD
Means any building, premises, place or thing which by reason of its nature, location, occupancy, condition or use may cause loss, damage or injury to persons or property by reason of fire, explosion or action of the elements.
PREMISES
Means any lot or parcel of land, exclusive of buildings thereon, and includes parking lots, tourist camps, trailer camps, airports, stockyards, junkyards, wharves, piers, and other places or enclosures however owned, used or occupied.

In the event of any conflict between the provisions of this chapter and any regulations established or promulgated by the state police through the fire marshal division, including the regulations governing places of public assemblage and school fire safety regulations, the latter shall prevail.

The fire chief shall have authority to designate any of his subordinates to perform the duties imposed upon him by the terms of this chapter.

In order to comply with the terms of this article, the Village Council hereby adopts by reference the International Fire Code, 2006 edition, published by the International Code Council, and all amendments and revisions thereto. The revisions thereof are hereby made a part of this article. Complete copies of the International Fire Code are available at the office of the Village Clerk for use and inspection by the public.

The fire chief shall have the power to modify any of the provisions of the International Fire Code upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code. The particulars of such modification when granted or allowed and the decision of the fire chief shall be entered upon the records of the department, and a signed copy shall be furnished the applicant.

(a)ย 
No person shall allow or permit any rags, waste, chips, trash, rubbish, wastepapers, ashes, oil, excelsior or other combustible material to accumulate on or in any premises or building owned by or occupied by him, except in metal or other fireproof containers so located as not to constitute a fire hazard, nor shall any person keep or maintain any paint, varnish or similar material unless such material shall be kept in closed containers when not being applied.
(b)ย 
No person shall kindle or maintain any ground fire, except when the ground is snow covered, without first securing a burning permit from the fire department. No person shall, in any event, kindle or maintain any fire unless the fire shall be located more than 25 feet from any building and shall be constantly attended until completely extinguished. The fire chief shall have authority to order the extinguishing of any fire whenever, in his judgment, the fire shall constitute a hazard because of high wind or other conditions. There will be no burning on any Village right-of-way.
