No person shall obstruct, encroach upon or occupy any street, alley or other public place or any portion thereof or erect any building, stairway or other structure therein, either temporary or permanent, without a permit from the Village Council.

All obstructions and encroachments in or upon any public street, alley or other public place; all buildings or other structures placed therein or thereon; and all devices or objects erected or placed in, upon or over any public street, alley or other public place in violation of the terms of this chapter, and all unauthorized changes in the grade, line or surface thereof, are hereby declared to be public nuisances and law enforcement officers shall have power and authority to remove and abate all such nuisances without notice and without liability for damages.

No person shall make any opening or excavation in or under any street, alley or public place or remove any earth from any street, alley or public place or erect any barricade therein without a permit from the Village Council or its agent. Prior to issuance of such permit, the council may require a bond conditioned upon proper performance of any contemplated work in, under or upon any street, alley or public place and also conditioned upon saving the Village harmless from any claims which may be made as a result of such work.

No person shall obstruct or encroach upon any public sidewalk or excavate under any public sidewalk or place any signs, awnings, awning posts and other things upon or over public sidewalks without a permit from the Village Council.

No person shall construct, lay or reconstruct any public sidewalk without a permit from the Village Council.

The council shall have power to build, maintain and keep in repair sidewalks and crosswalks in the public streets and alleys and to charge the expense of constructing and maintaining such sidewalks upon lots and premises adjacent to and abutting upon such walks. The council shall also have the authority to require the owners and occupants of lots and premises to build, rebuild and maintain sidewalks in the public streets adjacent to and abutting upon such lots and premises and to keep them in repair at all times, and to construct and lay the sidewalks upon such lines and grades and of such width, materials and manner of construction and within such time as the council shall by resolution prescribe, the expense thereof to be paid by such owner or occupant, or the council may by a two-thirds vote of all the trustees elect to pay such part of the expense of building or rebuilding such walk as they may deem proper from the general street fund or from the street district fund of any street district in which such walk may be located.

The owner or occupant of any lot or premises abutting upon any public sidewalk shall keep the same free of all sand, dirt, rubbish, litter and filth and shall remove promptly all snow and ice from such sidewalk.

If the owner or occupant of any lot or premises shall fail to construct or maintain any particular sidewalk as prescribed in this article or shall fail to keep the sidewalk in repair or to remove the snow, ice and filth therefrom or to remove and keep the sidewalk free from obstructions, encroachments, encumbrances or other nuisances or shall fail to perform any other duty required by the council in respect to such sidewalks within such time and in such manner as the council shall require, the council may cause the same to be done. Such sidewalk shall be constructed or repaired at the expense of such owner or occupant, and the council may cause the amount of all expenses incurred thereby, together with a penalty of 10% in addition thereto, to be reported to the board of special assessors, to be levied by them as a special tax or assessment upon the lot or premises adjacent to and abutting upon such sidewalk. Such special tax or assessment shall be collected according to the laws of the state, or the Village may collect such amount, together with the penalty aforesaid, from the owner or occupant of such premises in an action of assumpsit, together with the costs of suit.

(a) 
Specifications for concrete sidewalks are as follows:
(1) 
All sidewalks shall be five feet in width and a minimum of four inches thick.
(2) 
Sidewalks shall be constructed of Portland Cement Concrete (PCC) according to ASTM C 94 and state department of transportation (MDOT) grade 35 inches or the latest similar mix.
(3) 
Concrete shall have a six bag cement content and minimum twenty-eight-day compressive strength of 3,500 psi, and air content of 6.5% plus or minus 1.5% and a maximum three-inch slump.
(4) 
Placement and finishing of concrete shall conform to the latest specifications of the state department of transportation.
(5) 
A medium broomed finish shall be applied.
(6) 
After texturing, the surface shall be covered with a white-pigmented curing compound complying with ASTM C309 at a rate of one gallon per 200 square foot or by seven-day coverage with white polyethylene or waterproofed paper.
(7) 
Contraction joints to a depth of one inch shall be placed at five-foot intervals, made by sawing, tooling or installing an acceptable insert.
(8) 
Full depth expansion joints of an acceptable material shall be placed at fifty-foot intervals, longitudinally and wherever a sidewalk abuts any fixed objects, curb or other sidewalk.
(9) 
Full depth expansion joints shall also be located at spring points or curves in the sidewalk or at the beginning and end of the curves.
(10) 
Expansion joint material shall be placed on both sides of the sidewalk where driveways and walks are contiguous with each other.
(11) 
Expansion joint material shall be set one inch below the top of the sidewalk.
(12) 
The sidewalk shall slope 1/4 inch to the foot toward the roadway, to allow water to drain away.
