This article shall be known as the "East Earl Township Mailbox Reimbursement Ordinance."
East Earl plows a number of roads within its municipality during inclement weather. From time to time, mailboxes of citizens may become damaged inadvertently when snow removal equipment hits mailboxes.
The intent of this policy is to reimburse property owners who have been responsible in constructing, installing and maintaining mailboxes in such a way that can withstand accumulated or deposited snow.
It is hereby declared to be the policy of East Earl Township as follows:
A. 
The Township will reimburse a property owner for damage to a mailbox pursuant to the requirements of Subsection C and pursuant to the fees and costs established by resolution.
B. 
Alternatively, the Township will install a standard mailbox and/or post as necessary, in the discretion of the Township. Replacement may take several days depending on snowfall or workload.
C. 
This reimbursement of costs and replacement of mailboxes shall only be applicable to mailboxes and not media or newspaper boxes which are struck directly by snow-removal equipment. This policy does not apply to mailboxes that are damaged by thrown snow, windrows, or accumulated snow. A mailbox struck by snow-removal equipment will look demolished or have a clear indication of being struck by a plow blade.
D. 
In order to receive reimbursement or replacement of a mailbox pursuant to this article, a property owner must submit a written request within five days of the date of the damage to a mailbox that is struck directly by snow-removal equipment on a mailbox reimbursement form.
E. 
There will be no additional reimbursement for damage to a decorative or ornate mailbox.
A. 
If any sentence, clause, phrase or section of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, phrases, sections or parts of this article.
B. 
It is hereby declared as the intention of the Board of Supervisors of this Township that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause, phrase, section or part thereof not been included therein.
