No person other than a public officer or employee of the Town in the lawful discharge of his duties shall dig up any public street, way or alley which the Town is obliged to keep in repair, or open any drain, sewer, pipe or conduit therein for any purpose whatsoever, unless the same shall be done under a permit in writing granted by the Town Manager. The Town Manager may grant such permits upon such terms and conditions as he/she may deem expedient, and a record of all permits granted hereunder shall be kept by the Town Manager's office.
A. 
Criminal complaint. Whoever violates any of the provisions of this article may be penalized by indictment or on complaint brought in the District Court. Except as may otherwise be provided by law, and as the District Court may see fit to impose, the maximum penalty for any violation of these provisions shall be $300 for each offense. Each day on which a violation exists shall be deemed to be a separate offense; or

Noncriminal disposition. Whoever violates any provision of this article may be penalized by noncriminal disposition as provided in MGL c. 40, § 21D and may be punished by a noncriminal fine of $100 for the first offense, $150 for the second offense, and $200 for the third and subsequent offenses. Each day a violation continues shall constitute a separate offense.
