As used in this chapter, the following terms shall have the
meanings indicated:
As defined in N.J.S.A. 45:26-2, a power-operated hoisting
machine used in construction, demolition or excavation work, which
has a power-operated winch, load line and boom moving laterally by
the rotation of the machine on a carrier and has a manufacturer-rated
lifting capacity of 10 tons or more. It shall not include a forklift,
digger derrick truck, aircraft, bucket truck, knuckle boom, trolley
boom or any vehicle or machine not having a power-operated winch and
load line.
A.
Before any crane may be operated within the Township of Maplewood,
a permit shall be secured from the Township Building Department. A
form of application shall be prepared by the Township Building Department
and shall be completed for each application for a crane permit.
B.
In addition to any other requirements, the crane application shall
include a certificate of insurance, indicating applicable insurance
coverage of not less than $3,000,000 for bodily injury and property
damage.
C.
The application shall include the name or names of all individuals
who will operate the crane. Each individual named shall be an individual
who has been licensed by the State of New Jersey to operate a crane.
A copy of each operator's crane license shall accompany the application
for the crane permit. Only designated, licensed individuals may operate
licensed cranes.
D.
The application fee shall be $100, payable to the Township.
A.
Any person who operates a crane without the required license shall
be subject to a fine of $1,000 for each violation. Each day of illegal
operation shall constitute a separate and distinct offense.
B.
Any person or company who employs an unlicensed person as a crane
operator or permits or directs an unlicensed person to operate a crane
shall be subject to a fine of $1,000 for each violation. Each day
of illegal operation shall constitute a separate and distinct offense.
C.
Any person or company who allows an unpermitted crane to be used
on any job site within the Township shall be subject to a fine of
$1,000 for each violation. Each day of illegal operation shall constitute
a separate and distinct offense.
