The presently established Volunteer Fire Department
shall continue to function and serve as the Fire Department for the
City of Breckenridge.
The members of the Volunteer Fire Department
shall continue to elect annually a Chief, Assistant Chief and such
other officers as they deem advisable, subject to approval and confirmation
by the City Council.
The members of the Volunteer Fire Department
shall continue to be governed by their Constitution and bylaws and
any amendments which may be made thereto, which are not inconsistent
with the laws of the State of Minnesota, Charter provisions of the
City of Breckenridge and ordinances of the City of Breckenridge.
The members and officers of the Volunteer Fire
Department shall receive such compensation as the City Council may,
from time to time, provide for by resolution.

Members of the Breckenridge Fire Department
shall be paid through the City's normal payroll system. Officers shall
be paid their salaries once per month. All other payments to fire
fighters shall occur once every two months or six times per year.
The officers of the Fire Department shall prepare a listing of required
payments to the City Administrator or his/her designee at least three
days prior to the payment date.
The total membership of the Volunteer Fire Department
shall not at any time exceed that number which is sufficient to efficiently
operate the Fire Department taking into consideration the number of
members who normally will be absent from a fire. The limit on the
membership shall be set by the Fire Department subject to the approval
of the City Council.
The Mayor of the City shall have authority to
direct the Fire Department to send its personnel and equipment outside
the City for the relief of any other community or individual when
property or life is being endangered by fire or other emergency.
While engaged in combating of fire or dealing
with an emergency, the Mayor, Fire Chief and Assistant Fire Chief
shall have full police powers and may regulate traffic, remove and
keep away from the vicinity of the fire or emergency all persons whose
presence is not essential in combating the fire or dealing with the
emergency and perform any reasonable act or make any reasonable order
necessary to protect the public or safeguard property.

The Codes Administrator, Fire Chief and Assistant
Fire Chief shall have the authority to enter and inspect at reasonable
times all buildings, structures and premises within the City of Breckenridge
for the purpose of determining whether a fire hazard exists or the
provisions of any ordinance pertaining to the prevention of fire are
being violated.[1]

This article is adopted for the purpose of authorizing the City
of Breckenridge to charge for fire service as authorized by M.S.A.
§§ 366.011, 366.012, and 415.01.
Any deployment of firefighting personnel and/or equipment
to extinguish a fire or perform any preventative measure in an effort
to protect equipment, life, or property in an area threatened by fire.
It also includes the deployment of firefighting personnel and/or equipment
to provide fire suppression, rescue, extrication, and any other services
related to fire and rescue as may occasionally occur.
An agreement between the City and a township or other city
for the City to provide fire service.
The charge imposed by the City for receiving fire service.
Any self-propelled vehicle designed and originally manufactured
to operate primarily upon public roads and highways, and not operated
exclusively upon railroad tracks. It includes semi-trailers. It does
not include snowmobiles, manufactured homes, all-terrain vehicles,
or park trailers.
Parties affected are owners of property in townships or cities
to which the City provides fire service pursuant to a fire service
agreement.
Rates are per fee schedule located in signed fire service agreements.
A.
Parties requesting and receiving fire services will be billed directly
by the City of Breckenridge within 14 days of the fire service. Additionally,
if the party receiving fire services did not request services but
a fire or other situation exists which, at the discretion of the fire
department personnel in charge requires fire service, the party will
be charged and billed. All parties will be billed whether or not the
fire service is covered by insurance. Any billable amount of the fire
charge not covered by a party's insurance remains a debt of the
party receiving the fire service.
B.
Charges for fire service will be due according to the terms of the
fire service agreements. If the fire service charge is not paid when
due, the Township agrees to then pay the Breckenridge City Clerk.
C.
Pursuant to M.S.A. §§ 366.011, 366.012, and 415.01,
the City may use all practical and reasonable legal means to collect
the fire service charge.
D.
False alarms may be billed as a fire call.
When the City fire department provides fire service to another
fire department pursuant to a mutual aid agreement, the billing will
be determined by the mutual aid agreement.
When the City fire department provides fire service to another
fire department pursuant to a fire service agreement, the billing
will be determined by the agreement.
All collected fire charges will be City funds and used to offset
the expenses of the City fire department in providing fire services.
