On any corner lot on which a front or side yard is required, nothing shall be erected, placed, planted or allowed to grow or to continue in place in such a manner as to naturally impede vision between a height of two and one-half (2 1/2) feet and eight (8) feet above the grades of the bottom of the curb of intersecting streets or highways, measured from the point of intersection of the center line of the streets or highways, ninety (90) feet in each direction along the center line of the streets or highways.

Open fencing (fencing which does not reasonably obstruct a viewer's vision of what is on the other side of the fence, and which can be constructed of any suitable material), can be placed on lot or property lines but only as per survey at the cost of the landowner desiring to erect the fence, except that adjoining landowners may by written consent agree to placement of the fence along their boundaries. Before any such fence is erected, including privacy fences permitted by Section 405.330, the landowner wishing to construct the fence must obtain a building permit, pursuant to Chapter 503, and show proof of survey or consent by adjoining landowners and the same must be approved by the City Building Inspector and appropriate permit fee paid. In lieu of a survey, if adjoining landowners agree, survey markers or pegs or pins previously established by a survey of the property may be used to determine the property lines for purposes of building a fence according to City Code.

Privacy fences which are meant to impede vision through the fence for privacy purposes, can be no more than six (6) feet in height, and must be set back two (2) feet from lot lines or property lines, except that if the privacy fence is placed on an alley lot line, the privacy fence may be placed directly on the property line. However, to be placed on the property line, it is the responsibility of the landowner to establish the lot line by survey. Privacy fences shall not block or impede vision at a street or highway intersection as required by Section 405.310.
