Pursuant to Municipal Home Rule Law § 10(1)(ii)(a)(1)
and Real Property Tax Law § 328, the Town of Lyons hereby
adopts this chapter to change the elective office of Assessor to the
appointed office of but one Assessor.
Pursuant to Real Property Tax Law § 328, the term
of the presently elected and serving board of three Assessors shall
terminate on December 31, 2006, and the appointive office of Assessor
shall commence on such date.
The Town Board of the Town of Lyons has determined, pursuant
to Real Property Tax Law § 328, that this chapter shall
not be subject to a referendum.
This chapter shall supersede the prior retention by the Town
of Lyons of the position of elective Assessors.
