Occasional sales of household goods and personal property, including but not limited to sales designated as yard sales, garage sales, porch sales, moving sales, basement sales or household or personal goods sales, including estate sales, shall be permitted within the City limits upon the payment of a permit fee and after the issuance of a permit by the City Clerk, or his or her designee. The City Council shall set the permit fee from time to time by resolution. The City Clerk shall have the authority to waive the fee for community-wide sales.
Such occasional sales shall not be held on any premises more often than two times in any twelve-month period, and in no case shall any such sale exceed three days in duration.
Signs advertising sales governed by this chapter shall not be posted for more than four consecutive days, either on the property where the sale is occurring or on any other property in the City where permission has been granted to post a sign. Such signs are prohibited on utility poles and in the public rights-of-way.
Violation of this chapter shall be a municipal civil infraction, with a fine of $50 for a first offense, and a fine of $100 or more for any second or subsequent offense.
