The purpose and intent of this chapter shall be to allow the Code Enforcement Officer, at his discretion, to coordinate the plan review, inspections and reinspections of all energy installations regulated by the New York State Energy Conservation and Construction Code, and/or the Code of the Village of Fayetteville in the Village of Fayetteville.
A. 
Scope. Unless otherwise expressly stated, the words and terms shall, for the purpose of the Code of the Village of Fayetteville, have the meanings shown in this chapter.
B. 
Interchangeability. Words used in the present tense include the future; words stated in the masculine gender include the feminine and neutral genders; and the singular number includes the plural, while the plural number includes the singular. The word "shall" is always mandatory; the words "may" or "will" are always permissive.
C. 
Terms defined in other codes. Where terms are defined in the New York State Energy Conservation and Construction Code or in the Code of the Village of Fayetteville and are defined in the New York State Uniform Fire Prevention and Building Code (Uniform Code), such terms shall have the meanings ascribed to them as in those codes.
D. 
Terms not defined. Where terms are not defined through the methods authorized by this chapter, such terms shall have ordinarily accepted meanings such as the context implies. Webster's Third International Dictionary of the English Language, Unabridged, shall be considered as providing ordinarily accepted meanings.
E. 
Parts. Whenever the words "dwelling," "premises,", "building," "rooming house," "rooming unit," "housekeeping unit," or "story" are stated in the Code of the Village of Fayetteville, they shall be construed as though they were followed by the words "or any part thereof."
F. 
The following words or phrases, as used in this chapter, are defined as follows:
APPROVED ENERGY CODE PLAN REVIEW AGENCY
An entity or organization that employs or contracts with approved energy code plan reviewers to provide energy code plan reviews.
APPROVED ENERGY CODE PLAN REVIEWER
An individual knowledgeable in the application of the New York State Energy Conservation and Construction Code with a focus on construction plans, details and specifications, and having a background in architecture, engineering or code enforcement approved to review plans for compliance with the New York State Energy Conservation and Construction Code.
APPROVED ENERGY INSPECTOR
A residential or commercial energy inspector approved to inspect occupancies in the Village of Fayetteville.
G. 
The Codes Enforcement Officer shall be and is hereby authorized to approve the qualifications of all energy code plan reviewers who, in his opinion and discretion, are qualified to conduct energy inspections.
(1) 
The minimum qualifications of an energy inspector shall be in accordance with § 72-4 of this chapter.
(2) 
If an energy plan reviewer's qualifications are not acceptable, the energy code plan reviewer or energy code plan review agency may appeal the Codes Enforcement Officer's decision to the Village of Fayetteville's Board of Trustees.
H. 
In no event shall the cost or expense of such plan review, inspections or reinspections be a charge against the Village of Fayetteville, except that such inspection or reinspection is:
(1) 
Made on a property owned by the Village of Fayetteville.
A. 
Residential energy code plan reviewer and inspector: successful completion of a certification course offered by a New York State recognized agency such as the International Code Council's (ICC), Residential Energy Inspector/Plans Examiner 79, or equivalent as determined by the Code Enforcement Officer.
B. 
Commercial energy code inspector: successful completion of a certification course offered by New York State recognized agency such as the International Code Council's (ICC), Commercial Energy Code Inspector-77, or equivalent as determined by the Code Enforcement Officer.
C. 
Commercial energy plans examiner: successful completion of a certification course offered by a New York State recognized agency such as the International Code Council's Commercial Energy Inspector/Plans Examiner w/ASHRAE 90.1 - CE, or equivalent as determined by the Code Enforcement Officer.
D. 
Commercial energy plans examiner: successful completion of a certification course offered by a New York State recognized agency such as the International Code Council's Commercial Energy Code Plans Examiner-78, or equivalent as determined by the Code Enforcement Officer.
E. 
All inspectors shall have successfully completed the New York State Basic Code Enforcement Certification and required annual in-service training and mandatory code update training.
F. 
Equivalency for the above tasks will be determined by experience in the field of energy code compliance, education and experience related to the design of buildings, building mechanical systems, building science and construction, proof of successful completion of the basic certification course by offered New York State and certification of the annual in-service training from local chapter of New York State Building Officials Conference be provided annually to the Codes Enforcement Officer of the Village of Fayetteville.
G. 
Provide annually a certificate of insurance naming the Village of Fayetteville as additional insured for New York State's workers' compensation and disability insurance.
H. 
Provide annually a certificate of insurance naming the Village of Fayetteville as additional insured for commercial general, automobile and umbrella liability insurance for a minimum of $1,000,000.
Plan reviews conducted by an approved energy code plan reviewer shall be submitted to the Village on plan review forms acceptable to the Village in a format acceptable to the Village and with all other documentation required for a building permit.
The duly approved residential and/or commercial energy inspector is hereby authorized to examine plans for compliance with the New York State Energy Conservation Construction Code and make recommendations to the Village of Fayetteville for the issuance of energy permits and make inspections and reinspections, at reasonable times and places and upon reasonable notice, of all energy installations regulated and covered by the Uniform Code, the Energy Conservation Construction Code and/or the Code of the Village of Fayetteville in the Village of Fayetteville.
A. 
The energy inspector or energy inspection agency shall be authorized to conduct inspection and reinspections on properties that have a valid building permit issued by the Village of Fayetteville.
B. 
Upon issuance a permit and the subsequent request for an inspection from the permit applicant, the energy inspector or energy inspection agency shall immediately fax or email a copy of the request to the Village of Fayetteville's Codes Enforcement Officer.
C. 
Inspections required.
(1) 
The energy inspector or energy inspection agency shall make inspections and reinspections of energy installations in and on properties in the Village of Fayetteville to verify compliance with the New York State Energy Conservation Construction Code and the permit that was issued to the applicant. As required by the New York State Energy Conservation Construction Code the minimum inspections required are:
(a) 
Footing and foundation inspection. Exterior foundation insulation, slab edge insulation.
(b) 
Framing and rough-in inspection. Type of insulation, location of insulation, windows and doors per specification, air leakage.
(c) 
Plumbing rough-in inspection. Pipe insulation, heat traps, circulation controls.
(d) 
Mechanical rough-in inspection. System type, size, insulation, controls, leakage.
(2) 
Any person committing an offense against any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be punishable for each offense by a fine or by imprisonment as set forth in Chapter 113 of this Code.
