There shall be an Animal Control Officer whose duty it shall
be to enforce the rules and regulations of this Chapter. The Platte
County Sheriff and his/her duly authorized officers, deputies and
agents are hereby designated as the Animal Control Officer, authorized
to enforce the provisions of this Chapter.

Section 1.1 through Section 1.8 of the Platte County Animal
Control ordinance are hereby adopted, a copy of which is more particularly
set forth on Exhibit A attached hereto and made a part hereof.[1]

A.
Any person who shall violate or fail to comply with the rules and
regulations of this Chapter shall be deemed guilty of an ordinance
violation and the penalty therefor shall be as follows:
1.
For violation of Section 205.060, assessment of a fine up to twenty-five dollars ($25.00) for the first violation thereof, and upon conviction of a second and any subsequent such offense, assessment of a fine not less than twenty-five dollars ($25.00) nor more than three hundred dollars ($300.00).
2.
Upon violation of any other Section of this Chapter except Section 205.060, a fine of not less than fifty dollars ($50.00) for the first violation thereof. Upon conviction of a second and any subsequent violations thereof, by assessment of a fine not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00).
3.
In addition to the foregoing fines, any nuisance or cruelty
to animals resulting from violation or failure of compliance with
any provisions of this Chapter shall be abated and the person who
shall violate or fail to comply with the provisions of this Chapter
shall be responsible for all costs thereof.

The Mayor is hereby authorized to enter into an animal control
agreement with the County of Platte and the Sheriff's Department of
Platte County, Missouri, to provide animal control enforcement services
for the City of Edgerton, the form of such agreement shall be held
on file in the City offices.

A.
Purpose. The purpose of this policy is to establish procedures for
dealing with stray animals, nuisance animals and enforcement of the
State laws, County ordinances, and City of Edgerton ordinances with
respect to domestic and wild animals.
B.
General Policies.
1.
Duty Assignment.
a.
The Animal Control Officer will be assigned to the Patrol Division
of the Sheriff's Office, and will report to the assigned Patrol Division
Sergeant and Commander.
b.
The Animal Control Officer will be assigned an animal control
vehicle capable of transporting animals for impoundment. The Animal
Control Officer will be responsible for the sanitation of the vehicle
compartments and all equipment assigned.
c.
The Animal Control Officer will be provided equipment, including
but not limited to catch poles, tranquilizer gun/darts and traps,
which the Animal Control Officer will maintain in working condition
and obtain certifications to use said equipment.
d.
The Animal Control Officer will maintain records of all animals
impounded to include the final outcome of adoption, returning to owner
or euthanization. The Animal Control Officer will assist the designated
veterinarian in investigation of stray animals impounded in efforts
to reunite the animals with the owner.
e.
The Animal Control Officer will conduct investigations of State
law, County ordinance, and/or City of Edgerton ordinances with respect
to animals reported to the Sheriff's Office as well as patrol the
County of Platte looking for and investigating violations of law and/or
ordinances.
f.
The Animal Control Officer will be available for emergency call
outs and ensure the animal control vehicle will be available at the
request of a Patrol Division Sergeant or higher authority.
g.
The Animal Control Officer will assist local non-contractual
municipal agencies with transportation and/or apprehension of animals
in exigent circumstances only. The Sheriff's Office will not assume
financial responsibility for any treatment or boarding of the animal
in those circumstances, all financial responsibility will fall upon
the municipal agency requesting emergency assistance.
h.
The Animal Control Officer will maintain records of department
and officer licenses as required by State/Federal laws.
2.
Proper Utilization Of The Animal Control Officer. The Animal
Control Officer may be used while on duty without prior supervisory
approval for the following situations:
a.
Deputies in need of animal containment at calls for service
not related to animal matters.
b.
The response to and impoundment of stray animals and/or animal
bites.
c.
The response to investigations of animal cruelty/neglect, theft,
and all other violations of State law, County ordinances, or City
of Edgerton ordinances.
d.
Matters involving nuisance and/or aggressive wildlife animals.
The Animal Control Unit will work in unison with the Missouri Department
of Conservation regarding such matters.
C.
Impoundment Of Animals By Platte County Deputies.
1.
Impoundment Of Stray Dogs. The Animal Control Unit and commissioned
Deputies of the Platte County Sheriff's Office may impound stray dogs
located in unincorporated Platte County after reasonable efforts have
been made to locate an owner.
a.
The stray dog will be transported to the designated veterinarian
facility and/or animal shelter.
b.
The Deputy will complete the required forms at the veterinarian
facility and notify the Animal Control Officer of the impoundment
either by e-mail or forwarding a copy of the paperwork to the Animal
Control Officer's inbox.
c.
Stray dogs in contracted municipalities may be impounded by
Platte County Deputies only after the authorization from a Board of
Aldermen member of the respective City. The Animal Control Unit must
be notified of the impoundment as if impounded in unincorporated Platte
County.
2.
Impoundment Of Stray Cats, Removal Of Feral Cats. The Platte
County Sheriff's Office will not impound stray cats. The Animal Control
Unit may be notified of requests to remove feral cats in urban service
areas of unincorporated Platte County. The Animal Control Officer
will then be responsible for the trapping and subsequent euthanization
of feral cats.
3.
Impoundment Of Injured Domesticated Cats And Dogs.
a.
The only cats that may be impounded are injured domesticated cats and cats which have bit humans as outlined under Subsection (C)(4)(c) of this Section.
b.
Incidents after normal business hours, the Deputy must contact
the Animal Control Officer; if unavailable, must contact the designated
veterinarian prior to the impoundment of the injured dog or cat to
ensure the veterinarian is available to provide medical care. This
will not include medically ill animals.
4.
Dog And Cat Bites And The Impoundment Of.
a.
Deputies responding to calls for service involving a person
bit by a dog or domesticated cat will make reasonable efforts to locate
the owner of the dog/cat and obtain a copy of the animal's current
rabies vaccination.
b.
If the dog/cat owner cannot be located or the owner cannot provide
current rabies vaccination records, the animal will be impounded at
the designated veterinarian for a period of ten (10) days for observation.
c.
In incidents where a human is bit by a feral cat, the feral
cat will be collected by the Deputy and quarantined at the designated
veterinarian or animal shelter. The Deputy will immediately notify
the Animal Control Officer or designee to have the feral cat euthanized
and its remains sent off for rabies testing.
d.
The Deputy will notify the Animal Control Officer as outlined under Subsection (C)(1)(b) of this Section and will write bite observation on the form completed at the designated veterinarian.
e.
If the owner does provide current rabies vaccination records
to the responding Deputy, the Deputy will inform the owner to quarantine
the animal on their property for ten (10) days by not letting the
animal outside without the owner present and animal on a leash or
in confinement.
f.
The Deputy will forward a copy of the rabies vaccination records
to the Animal Control Officer.
5.
Livestock.
a.
Deputies responding to calls for service regarding livestock
which have escaped their confines will make reasonable efforts to
contact livestock owners in the area to claim the animal and/or herd
the animals back into their confinement.
b.
If the livestock cannot be returned to the field/pasture by
reasonable efforts of the responding Deputy(ies) and an owner cannot
be located, the Animal Control Unit will be notified by the responding
Deputies.
c.
The impoundment and/or transportation of livestock by agreement
and/or resources in place require the Patrol Commander or his/her
designee's approval.
