Any person within the City limits shall not keep or maintain hogs, horses, cattle, or goats within four hundred (400) feet of any residence or other dwelling place other than that of the owner, unless all occupants of residences or dwellings within four hundred (400) feet agree in writing to the person keeping or maintaining the hogs, horses, cattle, or goats. A violation of this Section is an ordinance violation. The fine for a first violation within a calendar year is fifty dollars ($50.00) plus court costs. The fine for a second or subsequent violation within a calendar year is one hundred dollars ($100.00) plus court costs.

A. 
Any person within the City limits may keep or maintain rabbits, chickens, ducks, turkeys, or other domestic fowl in accordance with the following provisions:
1. 
A person must apply for a fowl permit from the City of Edgerton and appear at a Board of Aldermen meeting for the Board to approve the permit. The applicant must show compliance with Section 205.190 and a member of the Edgerton Police Department must verify the compliance. The permit will be valid for one (1) year.
2. 
A permit may be renewed by appearing before the Board of Aldermen at the January meeting. The applicant must show continued compliance with Section 205.190, and the Edgerton Police Department will report any violations during the past year. There will be no cost for a renewed permit if no violations have been reported to the Edgerton Police Department. A renewed permit when there has been violations reported by the Edgerton Police Department will be twenty-five dollars ($25.00).
3. 
By receiving a permit, the applicant acknowledges that there is no vested right in keeping or maintaining rabbits, chickens, ducks, turkeys, or other domestic fowl, and the ordinance may change. The applicant acknowledges that any change to the ordinance must be complied with.
4. 
Rabbits, chickens, ducks, turkeys, or other fowl must have access to a covered enclosure (or coop) that has direct access to an enclosed run area. The enclosure or coop shall be located in the back yard.
5. 
The covered enclosure or coop and run area must be enclosed by a secure fence. Rabbits, chickens, ducks, turkeys, or other fowl shall not be outside the enclosed area.
6. 
The enclosure or coop must be properly maintained at all times.
7. 
The covered enclosure or coop shall be at least ten (10) feet from any property line and at least thirty (30) feet from any residential structure or business, not occupied by the person keeping or maintaining the rabbits, chickens, ducks, turkeys, or other fowl. The run area must be five (5) feet away from the property line.
8. 
The number of rabbits, chickens, ducks, turkeys, or other fowl is limited to fifteen (15) per property. Roosters and guinea hens are prohibited. This does not apply to non-domestic rabbits.
9. 
The sale of rabbits, chickens, ducks, turkeys, or other domestic fowl is prohibited unless a business permit is obtained and all applicable municipal, County, State, and Federal laws are complied with.
10. 
The slaughter of rabbits, chickens, ducks, turkeys, or other domestic fowls is prohibited except within a fully enclosed premises completely blocked from public view.
11. 
There shall be no excessive odors, noise, flies, disease, or unsightly appearance associated with rabbits, chickens, ducks, turkeys, or other domestic fowl.

A. 
Each individual violation of Section 205.190 will be deemed an ordinance violation, punishable by a period of probation or a fine. The fine for a first violation within a calendar year is fifty dollars ($50.00) plus court costs. The fine for a second or subsequent violation within a calendar year is one hundred dollars ($100.00) plus court costs.
B. 
Any violation of Section 205.190 may result in the Board of Aldermen revoking the permit. Upon receiving a violation, the Edgerton Police Department will issue a letter outlining the violation(s) and the permit holder will have ten (10) days to cure the violations. If the violation is not cured within ten (10) days, the Edgerton Police Department may present the matter to the Board of Aldermen who will hold a hearing to determine if the permit should be revoked. The permit holder will be given at least five (5) days' notice of the hearing. Any letter or notification shall be sent by registered mail or hand-delivered.

Sections 205.190 through 205.200 are enacted pursuant to the Police powers of the City of Edgerton for the health, safety, and welfare of the citizens of Edgerton.

It shall be unlawful for anyone to bring or allow any domesticated animal on the property of the City Ball Park located at the intersection of W. Perry Street and Hines Avenue. Any violation of the Section shall be punishable as set forth in Section 205.030(A)(2) of this Code.
