This chapter shall be known as the "Games of Chance Licensing Law of the Town of Mt. Morris."

Definitions as set forth in General Municipal Law Article 9-A are hereby adopted herein and made a part hereof.
The purpose of this chapter is to enable eligible not-for-profit organizations to raise funds through authorized and licensed games of chance, for charitable, educational, scientific, health, religious and patriotic purposes.
A.
Pursuant to New York State General Municipal Law Article 9-A, the New York State Constitution, the rules and regulations of the New York State Racing and Wagering Board[1] and any and all amendments to said statutes and regulations, it shall be lawful for any authorized organization, upon obtaining a license therefor, to conduct the games of chance within the territorial limits of the Town of Mount Morris subject to the provisions of this chapter, General Municipal Law Article 9-A and provisions of the State Racing and Wagering Board.

B.
The provisions of General Municipal Law Article 9-A, and the rules and regulations of the State Racing and Wagering Board adopted and any amendments thereof that may be adopted by the State of New York shall control and be applicable to the licensing of organizations and the conduct of games of chance in the Town of Mount Morris, and all such statutes and rules and regulations are hereby incorporated by reference and made a part hereof as if set forth in full herein.
The procedure provided in General Municipal Law § 190, Subdivision 3, for a summary application for authorized organizations that have previously obtained an identification number from the State Racing and Wagering Board and have previously applied for a license as set forth therein is hereby authorized.
It shall be authorized pursuant to General Municipal Law § 195 for authorized organizations to apply for a provision in their license to conduct games of chance on Sundays only between the hours of noon and midnight, but not on Easter Sunday, Christmas Day or New Year's Eve.
The powers and duties of enforcing this chapter as set forth in General Municipal Law Article 9-A shall be exercised by the chief law enforcement officer of Livingston County.
This chapter shall take effect upon being filed with the Secretary of State of the State of New York and following the approval by a majority of the qualified electors voting on a proposition submitted at the next general election held within the Town of Mount Morris.[1]
