It is the intent of this chapter that the requirements contained herein shall apply only to the erection, reconstruction, alteration, restoration, demolition or razing, which is visible from a public street or way, of or to buildings, structures and/or signs located, in whole or in part, within the Historic District.
Except as provided in § 314-9 of this chapter, if the proposed work is visible from a public street or way, no sign, building or other structure within the Historic District may be erected, reconstructed, altered, restored, demolished, razed or otherwise changed, in whole or part, until after a completed application for a certificate of appropriateness has been reviewed according to the procedures set forth in this chapter and approved or conditionally approved by the Council.
A.
Nothing in this chapter shall be construed to prevent the routine repair or maintenance or exact replacement in kind of any exterior elements or features of any building or structure, in whole or in part, within the Historic District. Pursuant to § 314-4, replacement in kind requires that replacement material must match the old, both physically and visually, in type or species, style, dimension, texture, and detailing.

Nothing in this chapter shall be construed to prevent the immediate and necessary construction, reconstruction or alteration of any exterior features or elements, or interior elements which affect exterior features or elements visible from a public street or way, of any building or structure, in whole or in part, which the COA Administrator and Building Inspector shall certify as required for health or safety reasons; provided, however, that the review procedures of this chapter as applied to any such work shall commence no later than 30 days following the date the COA Administrator and Building Inspector certify the need for such work.
