A. 
The Name Of The Board. The official name of the Board is the City of Warsaw, Missouri, Park and Recreation Board.
B. 
Purpose Of The Board. The Warsaw Park and Recreation Board serves as an advisory board to Warsaw's Board of Aldermen and to provide for the leisure recreational opportunities and facilities for all residents of Warsaw, while also promoting tourism related recreation. The Board shall be charged with assisting the Park and Recreation Director in advocating progress, determining programs and improvements to the recreation and park facilities, as well as voluntarily assist with activities, programs, and special events.
C. 
Board Qualifications.
1. 
The Board shall consist of seven (7) members, three (3) of which shall be appointed each year by the Mayor with the approval of the Board.
2. 
Board members shall be residents of the City of Warsaw, with the exception of up to three (3) members as determined by the Mayor that may reside in Benton County.
3. 
Board members shall hold office for three (3) years or until their successors have been appointed.
4. 
Board members shall be required to have a one (1) year break before he/she would be eligible to be reappointed to the Park and Recreation Board for another term. The only exception would be if a successor cannot be found within a 3-month period. At that time the Mayor will have the decision to request the Park and Recreation Board member be re-appointed or to extend the term temporarily while another member is found. (The three (3) year term would be an exception at first when lots shall be cast for their respective terms. Three (3) members for three (3) years, two (2) members for two (2) years and two (2) members for one (1) year.)
5. 
No member of the City of Warsaw Board of Aldermen shall be a voting member of the Park and Recreation Board.
6. 
The Mayor shall appoint a Park and Recreation Committee from the Board.
D. 
Removal Of Office. The Mayor may, by and with the consent of the Board, remove any member of the Park and Recreation Board for misconduct or neglect of duty. Neglect of duty shall be reviewed when a board member is unable to attend fifty percent (50%) of time in a 6-month period or when three (3) consecutive meetings have been missed.
E. 
Vacancies — No Compensation. Vacancies occasioned by removal, resignation or otherwise, shall be reported to the Mayor, who shall report to the Board of Aldermen, and shall be filled in like manner as original appointments, except the term of office is restricted to the unexpired term of office. No member of the Park and Recreation Board shall receive compensation as such.
F. 
Duties And Responsibilities Of The Board. General duties and responsibilities:
1. 
Ensure the improvement, maintenance, care and custody of the Parks and Recreational Programs by being involved in said parks and programs, attending events and volunteering time to be aware of how the above are operating and if there are suggestions or needs to make improvements. Assist in promoting programs to the general public and spreading positive awareness of all things Warsaw Parks and Recreation.
2. 
Advocate the recreation and park services into the community as well as determine and appropriately document the needs and desires of the community in regards to these services. Communicate these issues to the Park and Recreation Director and the Board of Aldermen Liaison.
3. 
Periodically evaluate:
a. 
The progress and status of all programs.
b. 
The effectiveness of ongoing recreation programs.
c. 
The level of maintenance of park areas.
d. 
Community needs.
e. 
Recreation and parks facilities.
f. 
Special events and additional sports and activities requests.
g. 
Periodically survey the community regarding parks and recreation needs, issues, and desired community requests.
G. 
Officers.
1. 
The offices of this Board shall be a President, Vice-President and Secretary. The Board shall elect the offices at the annual organizational meeting in January to serve for one (1) year or until a successor shall be elected and qualified. A member may serve no more than two (2) consecutive years as a Board President.
2. 
The Park and Recreation Board shall make, adopt and update Bylaws, rules and regulations for its own guidance proceedings as may be expedient not inconsistent with the Missouri State Sections 90.500 through 90.570 and the original organizing ordinance adopted by the Board of Aldermen of Warsaw, Missouri.
H. 
Duties Of Officers.
1. 
President.
a. 
The President shall preside and conduct all meetings of the Board. The President shall represent the Board at public affairs and shall maintain the dignity and efficiency of the board in all ways. He/She shall perform the other duties ordinarily performed by that office.
b. 
The President of the board shall present to the Board of Aldermen the Annual Report (August).
c. 
The report shall consist of, but not be limited to:
(1) 
The condition of the parks and recreation facilities and suggestions for the upcoming year.
d. 
The President shall prepare a manual for each new Park Board Member at the beginning of their term including the following information:
(1) 
Copy of the ordinance authorizing the Park and Recreation Board.
(2) 
Copy of Park and Recreation Board Bylaws.
(3) 
Copy of the current program guide.
(4) 
Copy of the current budget report.
(5) 
A list of each park area owned or operated by the City and a list of facilities at said locations.
(6) 
Copy of the latest Annual Report (August).
(7) 
Other reports that may be submitted to the Board.
(8) 
Any other information that would be helpful in acquainting new board members to the procedures and operation of the Park and Recreation Board.
2. 
Vice-President. In the absence of the President, the Vice-President shall perform all duties of the President. If both the President and Vice-President are absent, the Board shall elect a temporary President Pro-Tem who shall perform the duties of the president.
3. 
Secretary. A City employee shall perform the customary duties pertaining to this office. The secretary shall keep or cause to be kept a full and true permanent record of all meetings of the Board. This includes regular and special meetings plus reports of standing committees and the secretary shall be custodian of all documents. The secretary shall issue or cause to be issued notices of regular and special meetings. All meeting minutes must be submitted within the City Clerk within seven (7) days of all regular and special meetings.
I. 
Meetings.
1. 
Regular meetings shall be held the second Thursday of each month unless otherwise agreed upon by the Board.
2. 
Special meetings may be called by the President or on the written request of at least two (2) board members.
3. 
All regular meetings are held at the Warsaw Community Building unless otherwise noted on the official posted meeting agenda notice.
4. 
The meetings time shall be established in advance by the consensus of board members.
5. 
The annual budget review meeting shall be held at the regular monthly meeting in January of each year. The purpose shall be review of the final budget as passed by the Board of Aldermen.
6. 
The Park Board President along with the Park and Recreation Director shall make an annual report at the last August meeting of the year to the Board of Aldermen stating the condition and needs of the parks and recreation facilities. This meeting is in advance of the budget meeting for the upcoming year.
7. 
Five (5) members shall constitute a quorum at any regular or special meeting.
8. 
General meeting sessions are open to the public as outlined in the Missouri Sunshine Law, Chapter 610, RSMo.
9. 
Meetings shall be conducted in accordance with procedures prescribed in Bylaws and decisions reached only after full consideration and debate on the issue(s) in question.
10. 
The following shall be included in the order of business of the Park and Recreation Board but the Rules of Order may be suspended and any matters considered or postponed by action of the board. Included in the Order of Business are:

J. 
Amendments. Any amendments of these Bylaws can come to vote at a regular meeting of the Park and Recreation Board by majority vote and forwarded to the Board of Aldermen for approval.

A. 
Established; Purpose. A Board of Appeals is hereby established and created to hear and decide appeals pursuant to all building codes as may now or hereafter be adopted or otherwise amended by the City in Chapter 500 of the City Code hereinafter referred to in this Section as codes. Said board shall also hear and make findings of fact and orders as set out in the dangerous buildings code.
B. 
Composition. The Board of Appeals shall consist of five (5) members who are qualified by experience and training to pass upon matters pertaining to building construction. Three (3) alternate members may be appointed to serve in the absence of or the disqualification of the regular members. No member of the board shall be an employee of the City. The Building Official shall be an ex officio member of the board, and shall act as secretary of the board.
C. 
Appointed. The members of the Board of Appeals shall be appointed by the Mayor with the approval of the Board of Aldermen.
D. 
Terms. The members of the Board of Appeals shall serve for terms of five (5) years and until their successors are appointed and qualified; provided, the initial membership of the board shall be for terms of one (1) year, two (2) years, three (3) years, four (4) years and five (5) years, and thereafter a member shall be appointed each year for a term of five (5) years.
E. 
Compensation. The members of the Board of Appeals shall serve without compensation.
F. 
Vacancies. Any vacancy in the membership of the Board of Appeals shall be filled for the unexpired term by appointment in the same manner as provided for the initial appointments.
G. 
Removal Of Appointed Members. Any member of the Board of Appeals may be removed for cause by the Mayor and Board of Aldermen at any time upon written notice to such member of the causes for such removal and after a public hearing.
H. 
Officers; Rules And Regulations; Quorum.
1. 
The Board of Appeals shall elect from its membership a chairperson and vice-chairperson who shall serve for terms of one (1) year.
2. 
The Board of Appeals shall from time to time adopt rules and regulations not inconsistent with this Code and other ordinances of the City as may be necessary for the conduct of its investigations, and its organization and procedure.
3. 
Three (3) members of the board shall constitute a quorum for the transaction of business.
I. 
Powers And Duties. The Board of Appeals shall have certain powers and duties as follows:
1. 
To hear and decide appeals where it is alleged that there is an error in any order, requirement, decision or determination made by the Building Official in the interpretation or enforcement of the codes;
2. 
To determine the suitability of alternate materials and methods of construction as provided in the codes;
3. 
To recommend to the Board of Aldermen new ordinances consistent with the codes and other ordinances of the City;
4. 
To make reasonable interpretations of the provisions of the codes;
5. 
To have such other powers and duties as the Board of Aldermen may from time to time designate.
J. 
Meetings And Records.
1. 
Meetings of the Board of Appeals shall be held at the call of the chairperson and at such other times as the board may determine. The chairperson, or in his/her absence the vice-chairperson, may administer oaths and compel the attendance of witnesses. All meetings of the board shall be open to the public. The board shall keep minutes of its proceedings showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact, and shall keep records of its investigations and proceedings. All findings and decisions of the board shall be in writing, and the same shall be filed with the City Clerk with a copy to the Building Official and the appellant. Appeals to the board shall be processed in accordance with the codes, and other appropriate ordinances of the City and the laws of the State.
2. 
Copies of all rules and regulations adopted by the Board of Appeals shall be filed with the City Clerk, and shall be delivered to the Building Official who shall make them freely accessible to the public.
