This chapter shall be known and may be cited as the "Snowmobile
Ordinance of North East Township."

This chapter is enacted pursuant to Section 7722 of the Snowmobile
and All-Terrain Vehicle Law of Pennsylvania, 75 Pa.C.S.A. ยงย 7701
et seq. (hereinafter "Snowmobile Law"). It is the intent of the Township
Supervisors to comply with any and all provisions of the Snowmobile
and All-Terrain Vehicle Law and regulations promulgated thereunder.
It is the intent of the Township Supervisors to promote the
general welfare, safety and recreation of the residents of North East
Township by designating certain Township roads as snowmobile routes.

The following roads or sections of roads within the Township of North
East are hereby designated as snowmobile routes:

The above-named roads shall not be exclusively snowmobile routes,
but shall instead be posted as hereinafter provided and open to motor
vehicle traffic as well as snowmobiles. All snowmobiles using the
above-named roads shall comply with all traffic regulations and laws
of the Commonwealth of Pennsylvania.

The parts of the above-named roads that are by this chapter opened
to snowmobiles include all of the road from the beginning to the end
points as above-described, but where the beginning or end point is
another road, snowmobile access ends where the above-named road meets
the beginning or end road, and the intersection of the above-named
road with the beginning or end road is not open to snowmobiles or
in any way covered by this article.

The Township of North East shall erect signs designating the
above-named roads as snowmobile routes as provided for in the Snowmobile
Law and as further provided for by regulations promulgated by the
Department of Conservation and Natural Resources, 17 Pa. Code ยงย 51.83.
No snowmobiles may be operated on the above-named roads unless signs
are posted as required by this section.

All snowmobiles operated on the snowmobile routes designated
by this chapter must be registered with the Commonwealth of Pennsylvania,
Department of Conservation and Natural Resources, and bear the current
valid registration sticker as required by the Snowmobile Law.
All persons operating a snowmobile on the snowmobile routes
designated by this chapter must be licensed drivers in the Commonwealth
of Pennsylvania or elsewhere and have in their possession a current
valid operator's license.

General rule. No person shall operate a snowmobile in any of the
following ways:

Permitting unsafe operation. No owner or other person having charge
or control of a snowmobile shall knowingly authorize or permit the
operation of the snowmobile by any person who is incapable to do so
by reason of age, physical or mental disability, or who is under the
influence of alcohol or any controlled substance.

The operation of any snowmobile on the snowmobile routes above-designated
shall be subject to all applicable provisions of the Pennsylvania
Motor Vehicle Code[1] and the Snowmobile Law of the Commonwealth of Pennsylvania.

Any person who shall violate any provision of this chapter shall,
upon conviction, be subject to the penalties set forth in 75 Pa.C.S.A.
ยงย 7752.
If any part of this chapter is held invalid by a court of competent
jurisdiction, the remaining parts shall be severable and shall continue
to be in full force and effect.
