The Town Board of the Town of Berne hereby creates a council which shall be known as the "Town of Berne Youth Council."
The Youth Council shall consist of seven but not less than five members who shall be residents of the Town of Berne and who shall be appointed by the Town Board for terms not to exceed two years. Two members shall be appointed for one year and three members for two years. In the event of a seven-member Council, the sixth member shall be appointed to a one-year term and the seventh member to a two-year term. Vacancies on the Youth Council shall be filled in the same manner as the original appointment, except that a vacancy occurring other than by the expiration of term of office shall be filled only for the remainder of the unexpired term.
Each year at the first meeting of the Youth Council, its members shall elect from among themselves a recording secretary. The Youth Council shall adopt rules of procedure for its meetings. It shall keep accurate records of its meetings and activities and shall file an annual report to the Town Board.
The Youth Council shall have the following powers and duties:
A. 
Meet at a regularly scheduled time and place.
B. 
Address concerns related to youth services and recreation.
C. 
Refine and develop quality youth services and programs which engage youth of all ages.
D. 
Evaluate and plan programs:
(1) 
Review participation levels.
(2) 
Review cost of programs and available funding.
(3) 
Review program objectives.
(4) 
Review staff evaluations.
E. 
Develop and recommend protocols which enhance the safety of program participants and staff.
F. 
Recommend to the Town Board one candidate for appointment to the positions of Director and Deputy Director.
G. 
Seek input from the community, including youth.
H. 
Coordinate efforts and activities with neighboring towns when feasible.
I. 
Consider and implement year-round programming with a minimum of three programs per year.
J. 
Submit recommendations to the Town Board for approval.
K. 
Obtain completed Town of Berne permission slips for program participation, medical release, and travel signed by the legal guardian for all children unaccompanied by their parent, legal guardian, or authorized adult.
L. 
Obtain Town Board approval for overnight excursions.
A Director shall be appointed by and serve at the pleasure of the Town Board to serve a term of two years. The Youth Council shall recommend a candidate for the position to the Town Board. The duties of the Director include:
A. 
Chair all Youth Council meetings.
B. 
Set the agenda for Youth Council meetings, accepting input from Council members.
C. 
Direct and supervise programs and activities.
D. 
Recommend policies and procedures in coordination with Council members for Town Board review and approval.
E. 
Plan and evaluate programs in coordination with Council members.
F. 
Be responsible for all reports and all necessary documentation.
G. 
Recommend to the Town Board applicants for Youth Council Assistant(s) deemed acceptable by the majority of Youth Council members.
H. 
Apply for grants that support the work of the Youth Council.
I. 
Oversee the Youth Council budget.
J. 
Approve all purchases ensuring they remain within the procurement policy mandates.
K. 
Order supplies through the Town Clerk whenever possible.
L. 
Receive and submit to the Town Clerk any receipts for purchases made by Youth Council members.
A Deputy Director shall be appointed by and serve at the pleasure of the Town Board to serve a term of one year. The Youth Council shall recommend a candidate for the position to the Town Board. The duties of the Deputy Director include:
A. 
The Deputy Director shall assume and perform the duties of the Director in the event of the absence or disability of the Director, or a vacancy of that office occurs.
B. 
The Deputy Director shall assume delegated duties and functions of the Director in his/her absence, or in the event of excessive demand on the Director.
C. 
The Deputy Director shall represent the Youth Council in circumstances when the Director is not available.
Yearly appropriations will be determined by the Town Board.
A. 
The Youth Council may not conduct fundraising campaigns.
B. 
The Youth Council may accept donations which must be turned in to the Town Clerk for deposit in the Town's General Fund.
C. 
The Director of the Youth Council will oversee the budget allocated by the Town Board.
D. 
The Director must approve all Youth Council spending.
E. 
The Youth Council Director will sign and approved all grant requests, submitting any requiring matching funds to the Town Board for approval.
The Director of the Youth Council shall submit an annual report to the Town Board, outlining activities and work of the Youth Council. Other reports and recommendations the Youth Council deems necessary or advisable, or are requested by the Town Board, shall be submitted by the Director.
The members of the Youth Council and Deputy Director shall receive no compensation for their services as members thereof. The Director shall receive a salary to be determined by the Town Board. Assistant(s) shall receive a salary to be determined by the Town Board.
