All driveways shall be located, designed and constructed in
a manner which will not interfere with the maintenance and drainage
of North East Township roads or the safe and convenient passage of
traffic upon North East Township roads.
Before beginning any construction of any proposed driveway,
the person desiring to construct the driveway shall make application
to the Zoning Officer of the Township of North East for approval of
the location, design and construction of the driveway and for permission
to proceed. The form of the application will be made available to
any applicant upon request. No person shall begin construction of
any proposed driveway before receipt of a Township permit approving
the location, design and construction thereof, signed by the Zoning
Officer, and containing such terms and conditions as the Zoning Officer
may find it necessary to impose.
All driveways shall be maintained so as not to interfere with
the design, maintenance and drainage of or the safe and convenient
passage of traffic upon the Township roads.

For any and every violation of the provisions of this chapter,
the owner, general agent or contractor or any other person who knowingly
commits, takes part or assists in any violation shall, upon conviction
in a summary proceeding brought before a Magisterial District Judge
under the Pennsylvania Rules of Criminal Procedure, be guilty of a
summary offense and shall be punishable by a fine of not less than
$100 nor more than $1,000, plus costs of prosecution. In default of
payment thereof, the defendant may be sentenced to imprisonment for
a term not exceeding 90 days. Each day or portion thereof that such
violation continues or is permitted to continue shall constitute a
separate offense, and each section of this chapter that is violated
shall also constitute a separate offense.
The basic considerations that shall govern the location and
construction of driveways shall be:
A. To facilitate the safe movement of traffic across and upon Township
roads;
B. To prevent the unnecessary accumulation of water on the Township
roads because of improper or inferior driveway drainage systems.
