All driveways shall be located, designed and constructed in a manner which will not interfere with the maintenance and drainage of North East Township roads or the safe and convenient passage of traffic upon North East Township roads.
Before beginning any construction of any proposed driveway, the person desiring to construct the driveway shall make application to the Zoning Officer of the Township of North East for approval of the location, design and construction of the driveway and for permission to proceed. The form of the application will be made available to any applicant upon request. No person shall begin construction of any proposed driveway before receipt of a Township permit approving the location, design and construction thereof, signed by the Zoning Officer, and containing such terms and conditions as the Zoning Officer may find it necessary to impose.
All driveways shall be maintained so as not to interfere with the design, maintenance and drainage of or the safe and convenient passage of traffic upon the Township roads.

For any and every violation of the provisions of this chapter, the owner, general agent or contractor or any other person who knowingly commits, takes part or assists in any violation shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not less than $100 nor more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
The basic considerations that shall govern the location and construction of driveways shall be:
A. 
To facilitate the safe movement of traffic across and upon Township roads;
B. 
To prevent the unnecessary accumulation of water on the Township roads because of improper or inferior driveway drainage systems.
A. 
Where the approach and highway pavement meet, flaring of the approach shall be permitted to allow safe and easy turning of the vehicle, either into or from the driveway.
B. 
Where highway curbs exist, approaches at the curbline shall be installed 1 1/2 inches above the adjacent highway or gutter grade.
C. 
No part of any driveway shall be constructed within the street or road right-of-way without approval of the North East Township Roadmaster Foreman as to design and material.
A. 
Where there are open shoulders or berms, the driveway grade shall slope away from the roadway pavement at a rate of not less than 1/4 inch per foot nor more than one inch per foot for a distance equivalent to the prevailing width of the shoulder.
B. 
Where a drainage ditch exists or where the contour of the land is such that construction of a driveway will cause surface water to run onto the surface of the roadway, a drainage pipe shall be installed under the driveway in a size determined by the Township Roadmaster and approved by the North East Township Zoning Officer.
C. 
Approaches shall be built with any aggregate, such as gravel, stone, slag or mixtures of such aggregates with soil, placed in a manner as to provide a smooth, stable all-weather surface not subject to undue raveling or with a higher material optional.
