The Director of Licensing and Inspections is hereby appointed to serve as the Municipal Code Official to act on behalf of Upper Southampton Township in accordance with the Pennsylvania Construction Code Act.[1]

A. 
The Board of Appeals as required by the Pennsylvania Construction Code is hereby established and created.
B. 
Membership shall consist of five members appointed by the Board of Supervisors at its first meeting in January for a term of five years, or until their successors are appointed, provided that the members of said Board of Appeals first appointed shall be appointed for varying terms so that no more than one term shall expire annually.
C. 
The composition of the Board of Appeals is governed by all of the following:
(1) 
A member of the Board of Appeals shall be qualified by training and experience to pass on matters pertaining to building construction. Training and experience may consist of licensure as an architect or engineer, experience in the construction industry, and training or experience as an inspector or plan reviewer.
(2) 
A member of the Board of Appeals holds office at the pleasure of the municipality's governing body.
(3) 
Members of a municipality's governing body and its code administrators may not serve on a Board of Appeals.
(4) 
A municipality may fill a position on the Board of Appeals with a qualified person who resides outside of the municipality when it cannot find a person within the municipality who satisfies the requirements of this section.
(5) 
Members shall serve without compensation.
(6) 
The Board of Appeals shall have the powers and duties established by the Pennsylvania Construction Code Act, as amended, as well as any applicable administrative regulations.
The BOCA Board of Appeals and the Fire Prevention Board of Appeals are hereby abolished.
This article shall become effective immediately upon adoption.
