The Board of Appeals as required by the International Property Maintenance Code, 2000 edition, as amended, is hereby established and created.
Membership of the Board of Appeals is governed by all of the following:
A. 
Membership of the Board of Appeals shall consist of three members appointed by the Board of Supervisors.
B. 
Each member shall serve a term of three years whose term shall expire on the first Monday in January, provided that the members of said Board of Appeals first appointed shall be appointed for overlapping and staggering terms so that no more than one term shall expire annually.
C. 
A member of the Board of Appeals shall be qualified by experience and training to pass on matters pertaining to property maintenance and who are not employees of Upper Southampton Township.
D. 
The Code Official shall be an ex-officio member but shall have no vote on any matter before the Board.
E. 
The Board of Supervisors shall appoint two or more alternate members who shall be called by the Board Chairman to hear appeals during the absenteeism or disqualification of a member. Alternate members shall possess the qualifications required for Board membership.
F. 
The Board shall annually select one of its members to serve as chairman.
G. 
The Board of Supervisors may fill a position on the Board of Appeals with a qualified person who resides outside the Township when it cannot find a person within the Township who satisfies the requirements of this section.
Members of the Board of Appeals shall serve without compensation.
The Board of Appeals shall have the powers and duties established by the International Property Maintenance Code, as amended, as well as any applicable administrative regulations.
This article shall become effective immediately upon adoption.
