[HISTORY: Adopted by the Borough Council of the Borough of West Reading 8-21-2018 by Ord. No. 1095. Amendments noted where applicable.]
As a result of the background paragraphs above,[1] which are incorporated herein, it is hereby ordained and enacted that no permission is granted by the Borough to any person to ignite or discharge consumer fireworks on the streets of the Borough of West Reading, the sidewalks of the Borough of West Reading or any property owned by the Borough of West Reading, including, without limitation, all of the Borough's parks and public buildings.

The staff of the Borough of West Reading be and hereby are directed to provide copies of this chapter to the Magisterial District Judge within the Borough of West Reading to provide judicial notice that no permission has been granted by the Borough for any person to intentionally ignite or discharge consumer fireworks on the Borough streets and sidewalks or on any real estate owned by the Borough of West Reading.

Any person who violates or permits a violation of this chapter shall, upon being found liable therefor, pay a fine of not more than $100, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Berks County.
