There is hereby established and created within the City Government
an executive department to be known as the Board of Public Works.

A. The Board of Public Works shall consist of four (4) members, all
of whom shall be electors of the City and must have resided within
twenty-five (25) miles of the City limits of the City of Malden for
two (2) years next preceding before their appointment; provided that
not more than two (2) members shall belong to the same political party,
and all acts of such Board shall be entirely non-partisan.

B. All members of the Board of Public Works shall be appointed by the
Mayor and approved by a majority of the members elected to the City
Council, in such manner as other appointive Officers of the City,
and one (1) member shall be appointed each year during the month of
May. Each member shall hold office for a term of four (4) years and
until his successor is duly appointed and qualified.

Each member of the Board of Public Works shall give such bond
as may be prescribed by ordinance.

Any member of the Board of Public Works who shall accept a nomination
or appointment for any other office during his term shall be deemed
to have resigned as a member of such Board, and his membership shall
thereby be ipso facto vacated.

Any vacancy in the membership of the Board of Public Works shall
be filled for the unexpired term by the same manner as prescribed
in this Article for an original appointment.

As soon as may be practicable each year after the appointment
of a new member, the Board of Public Works shall elect a President,
Vice President and Secretary.

The Board of Public Works shall preserve a true record of all
its proceedings and official acts, which shall be attested by the
Secretary of the Board.

The Board Of Public. Works shall take charge of and exercise
control over the Municipally owned waterworks, combined waterworks
and sewerage system, Electric Light and Power Plant, and shall enforce
the performance of all contracts and work relating thereto and have
charge and custody of all books, property and assets belonging or
appertaining to each such plant and system.

The assessment and collection of rates for water, electric power
and electric lights shall be under the control and supervision of
the Board of Public Works subject to the provisions of this Code and
other ordinances of the City.

The Board of Public Works shall appoint a Chief Superintendent
and such subordinates it deems necessary; provided that the number
of employees and the compensation therefor shall be approved by the
City Council and shall conform with the provisions of this Code and
other ordinances relating to personnel of the City Government.

The Board of Public Works shall contract for the performance
of work in the same manner as other public works are let out, and
all contracts shall be submitted to the Mayor and City Council for
their approval.

All bills for expenses of the Board of Public Works and for
salaries of its employees shall be allowed and paid in the same manner
that other bills and salaries of other Officials and employees of
the City are allowed and paid.

The Board of Public Works shall keep books of account showing
with entire accuracy contemporaneous current entries of the receipts
and expenditures of the Board in such manner as to enable such records
to be understood and investigated, and shall preserve on file in its
office duplicate vouchers for all its expenditures, which books and
duplicates shall at all times be open to the examination of the Finance
Committee of the City Council, or any other committee appointed by
the common Council, and shall make reports of its business and transactions
to the Mayor and City Council each month and at any other time as
might be requested by the Mayor and the City Council.

The Board of Public Works shall, as may be necessary from time
to time promulgate rules and regulations governing the furnishing
of water, sewer, electric power and electric light services to customers,
the measurement of services provided to customers and the establishment
of rates for such services, the billing of customers and the collection
of such bills, the discontinuance of service when any bill therefor
is in arrears, and other matters necessarily incidental to such services
and which require regulation; and all such rules and regulations,
when approved by the City Council and filed in the offices of the
City Clerk and the Board of Public Works, shall have the force and
effect of an ordinance.
