It shall be the duty of the Council to name a person to act as City Clerk and said person shall be approved by majority vote of the Councilpersons present and voting, and said City Clerk shall be under the authority of the Mayor and/or City Council and the job shall be advertised and subject to rules and hiring practices of all other City employees.

Within fifteen (15) days after his election by the City Council, and before entering upon the discharge of the duties of his office, the City Clerk shall execute to the City a bond in such amounts and with such sureties deemed sufficient by the City Council, conditioned that he will faithfully discharge all the duties of his office as required by the laws of the State governing Cities of the Third Class and the provisions of this Code and other ordinances of the City, and that he will promptly pay over all money coming into his possession that belong to the City, at the time and in the manner provided by law. Such bond, with the Mayor's approval endorsed thereon, shall be filed in the office of the Mayor who shall preserve and safely keep it.

The City Clerk shall, among other duties, keep the journal of the proceedings of the Council. He/she shall safely and properly keep all records and papers belonging to the City which may be entrusted to his care, and generally shall perform all the duties required of him by ordinance or orders of the Council. He is hereby empowered to administer official oaths, and also oaths to persons certifying to demands or claims against the City.

The City Clerk shall have the power, with the consent of the City Council, to appoint a Deputy City Clerk, who shall perform such duties and have such powers as are by this Article conferred upon the City Clerk. Such Deputy shall be subject to removal at will by the City Clerk, and shall receive such compensation as the City Council shall from time to time provide.

Whenever, for any reason, the City Clerk is absent or unable to perform the duties of his office, the City Council may, by resolution, appoint a temporary City Clerk, who shall have all the powers and duties of the regular Clerk, and receive the same salary for the time he so acts, but in no event shall both the regular and temporary City Clerks receive pay at the same time, nor shall the regular Clerk receive any pay for the time that he fails to perform the duties of his office as provided in this Article.

If by any cause a vacancy shall occur in the office of City Clerk, the City Council shall fill such vacancy as set out in Section 115.150 of this Article. For that purpose, it shall be the duty of the Mayor to convene the City Council in special session.
