It shall hereafter be unlawful for any person, either as principal
or agent, at any time, to sell, use, store, discharge, ignite, or
explode (except for public display purposes, under license as hereinafter
provided) at any point within the Borough of Quarryville, and of the
following articles of fireworks:
A.
Toy torpedoes, fire crackers, and salutes.
B.
Top pistol paper cape containing more than 0.35 grain of explosive
mixture.
C.
All skyrockets, flower pots, fountains, Roman candles, flash fire
crackers, flash salutes, dago bombs, cherry bombs, whoopee salutes,
or any similar articles manufactured or sold under any other trade
name.
D.
Balloons, parachutes, or like articles carrying lighted substances.
E.
Any toy cannon, cane, pistol, or other device designed for the purpose
of exploding blank cartridges or gun powder; provided, that nothing
herein contained shall forbid the sale, storage, or use of toy paper
cap pistols designed for, and used with paper caps containing less
than 0.35 grain of explosive mixtures.
F.
Any articles containing a compound, or mixture of yellow or white
phosphorous or mercury.
G.
Fireworks containing an ammonium salt and chlorate or perchlorate;
or fireworks in which a nitrate and chlorate are combined.
H.
Explosive fireworks in which detonation is produced or assisted by
magnesium or aluminum, or any finely divided metals.
Any person desiring to sell, use, store, discharge, ignite, or explode fireworks of the kind enumerated in § 207-1 hereof for a public display shall first obtain from the Borough Secretary a permit in writing for such purpose. Ten days' prior written application for such permit shall be made to said Secretary, who, after making an investigation and being satisfied that the applicant is competent to use and display fireworks and that the public will not be endangered because of the location of the place at which it is desired to use the same, may issue a permit for such public display of fireworks, which permit shall authorize the holder to purchase and possess the fireworks which are to be so displayed between the date of issuance of such permit and the time for which the display of said fireworks is authorized. No fee shall be charged for the above-described permit.
Fireworks of the kind not enumerated in § 207-1 hereof may be sold and privately used on the second, third, and fourth days of July (and on the fifth day of July when the fourth day falls on Sunday) of each year; but it shall be unlawful for any person, either as principal or agent, to sell, use, discharge, ignite, or explode any such fireworks at any time other than on the days mentioned in this section.
As used in this chapter, the following terms shall have the
meanings indicated:
Includes a firm, corporation, or individual.
Any person who shall violate any of the provisions of this chapter
shall, upon conviction in a summary proceeding, be subject to a penalty,
and fined in the sum of not less than $5 nor more than $25 for each
offense.
