Smoking within the boundary of Westampton Township owned land, or any property which is owned, maintained or in the possession of the Township of Westampton, including but not limited to all parks, playgrounds, active and passive recreational facilities, the Municipal Building, the Public Works garage, the fire house, Springside Recreation Department, and the Westampton Sports Complex, shall be limited to only designated smoking areas or more than 25 feet from any door to a Township-owned building.
As used in this chapter, the following terms shall have the meanings indicated:
SMOKE
The gases, particles, or vapors released into the air as a result of combustion, electrical ignition or vaporization, when the apparent or usual purpose of the combustion, electrical ignition or vaporization is human inhalation of the by-products, but excluding incense or similar products inhaled solely for olfactory purpose so long as the products do not contain tobacco or nicotine. The term "smoke" includes, but is not limited to, tobacco smoke, electronic cigarette vapors and marijuana smoke.
This chapter shall be enforced by the Westampton Township Police Department.
A. 
Any person found to be in violation of this chapter shall be issued a summons and shall be subject to the following penalties:
(1) 
First offense: a fine of not less than $100 and not to exceed $150.
(2) 
Second offense: a fine of not less than $150 and not to exceed $250.
(3) 
Subsequent offenses: a fine of not less than $300 and not to exceed $500.
B. 
In addition to the above penalties, any person found to be in violation of this chapter shall also be responsible for all costs of prosecution.
