This chapter shall be known and may be cited as the "Salisbury
Township Campground Ordinance."
The use of the singular shall include the plural, and the use
of the plural shall include the singular. The masculine gender shall
include the feminine and neuter genders. Unless otherwise expressly
stated, the following words and phrases shall have the meanings stated:
A licensed and inspected vehicular portable structure to
be mounted on a chassis or wheels and towed or constructed as an integral
part of a self-propelled vehicle for use as temporary dwelling for
travel, recreation and vacation, commonly known as recreation vehicles,
travel trailers, pickup coaches, motor homes or camping trailers.
A tract or tracts of land or any portions thereof used for
the purpose of providing sites for the temporary use of campers or
tents, as herein defined, for camping purposes, with or without a
fee being charged for the leasing, renting or occupancy of such space.
A parcel of land in a campground for the placement of a single
trailer and/or tent and the exclusive use of its occupants.
The Pennsylvania Department of Environmental Protection (PADEP)
Bureau of Safe Drinking Water and its authorized representatives.

Any natural person, association, partnership, firm, corporation
or other legally recognized entity.
Common space available to all registered campers.
Any structure or appendage to a structure, whether principal
or accessory, constructed or used for a residence, business establishment
or other private or public purpose or which is designed for the housing,
shelter, enclosure or support of persons, animals or property of any
kind.
A portable lodging unit usually made out of skins, canvas,
plastic or strong cloth stretched and usually sustained by poles and
dependent upon separate toilet and lavatory facilities.

No person shall operate a campground in the Township, except
as authorized by this chapter and only after having obtained a license
for the operation of a campground in accordance with this chapter.
Application for a license to operate a campground shall be made
in writing by any campground operator under oath and in the form prescribed
by the Board of Supervisors of the Township. If the applicant is a
partnership or association, the application shall furnish the names
and addresses of all partners. If the applicant is a corporation,
the application shall furnish the names and addresses of each officer
and director thereof. The application shall be signed by the applicant,
if the applicant is an individual, by all members of the association
or partnership, if the applicant is an association or partnership
and by the president and attested by the secretary, if the applicant
is a corporation.
An application for a campground license shall be accompanied
by a plan for the proposed/existing campground. Such plan shall include
the location of all property lines, streets and roads, campsites,
utility services, permanent structures, recreational areas and other
facilities. The plan shall be drawn at an appropriate scale to provide
ease of review, but at no less than one inch equals 100 feet.
No license issued under this chapter shall be transferred or
assigned or used by any person other than the one to whom it was issued,
and no campground license shall be issued for any location other than
the one prescribed in the application upon which it is issued.
Any campground operator shall pay an annual license fee as established
by the then current fee schedule adopted by resolution of the Board
of Supervisors.

Upon receipt of an application, the Board of Supervisors shall review the license application and operational plans contained therein to determine if the requirements of ยงย 148-9 herein are met and whether the applicant has obtained all other permits and approvals required, including, but not limited to, subdivision and/or land development approval. The Board shall determine additionally whether any outstanding notices of violation of Township ordinances exist. No license shall be granted or renewed unless the application and operational plans are in compliance with this chapter; the applicant has received all zoning and subdivision and/or land development approvals; the applicant has received all approvals from the Department; and the applicant does not have outstanding violations of other Township ordinances.

Any person who has been denied a license or whose license has been
suspended or revoked may appeal the denial, suspension or revocation
to the Board of Supervisors. Such appeal shall be made, in writing,
within 10 days after such decision was made. The appeal shall be verified
by an affidavit and shall be filed with the Township Secretary. The
appellant or his representative shall have the right to appear and
be heard, if such right is requested in written appeal. The appeal
shall be accompanied by the appeal fee established by resolution of
the Board of Supervisors.

If the application for a license to operate a campground is granted,
the Zoning Officer shall issue a license to the applicant designating
the name of the campground operator, the address of the campground,
and the applicable dates of the license.
D.ย
All campground licenses shall be conspicuously posted upon the premises
operated as a campground.
E.ย
All licenses shall be valid for a period of one year after the date.
F.ย
The Supervisors may revoke, suspend or refuse to renew a license
at such time as there is evidence of noncompliance with this chapter.
Individual campsites shall contain a minimum area of 1,500 square
feet with a minimum width of 25 feet. Each campsite shall provide
a clear, level, well-drained pad for accommodating the trailer, camper
or tent.
The owner and/or operator of a campground shall be responsible
for the maintenance of such campground. Such maintenance shall include,
but not be limited to:

Maintain at all times a register of all occupants, which shall be
open to inspection by the officers or agents of the Township. The
register should include:

Maintain the campground in a clean, orderly and sanitary condition
at all times.
C.ย
Prevent the running at large of dogs, cats or other animals.
D.ย
Prohibit the burning of trash or rubbish within the campground.
E.ย
Maintain control of rodents, vermin, insects and other pests.
F.ย
Prevent disorderly conduct or the violation of laws or ordinances
within the campground and immediately report to the Township any violation
of laws or ordinances.
G.ย
Ensure that all ground surfaces are paved, covered with solid material
or protected with vegetative growth that is capable of preventing
soil erosion and the emanation of dust during dry weather.
H.ย
Maintain the grounds of the campground free of vegetative growth
which is poisonous or which may harbor rodents, insects harmful to
humans or other pests harmful to humans.
I.ย
The water supply for the campground shall be a proper distance from
any source of contamination, must be of adequate capacity to supply
the campground and must be approved by the Department. The campground
owner is to furnish a copy of all well testing data to the Township.
J.ย
All campground shall comply with the regulations of the Department,
as set forth in Title 28, Health and Safety, of the Pa. Code, Ch.
19, Organized Camps and Campgrounds. Violations of the above shall
constitute violation of this chapter and such violation shall be subject
to penalties described herein.

K.ย
The erection of any structure within a campground, including, but not limited to, the erection of utility sheds at camping sites by persons who have leased such camping sites, shall comply with the requirements of all applicable Township ordinances, including, but not limited to, Chapter 340, Zoning, of the Code of the Township of Salisbury. All required permits shall be obtained prior to the erection of any structures within a campground.

In addition to compliance with the standards set forth in this chapter,
the Township Supervisors may make additional requirements as deemed
necessary to protect the health, safety and morals and general welfare
of the public. Such additional requirements shall be outlined during
the license application for the campground and shall be complied with
prior to issuance of renewal of a license.
Every campsite that offers electrical supply shall be installed
and maintained in accordance with local electrical power company specifications
and the National Electrical Code prior to the electric power being
energized.
Any person operating a campground within the Township at the
time of adoption of this chapter shall make application for a license
within 90 days.
Any campground license shall be subject to revocation by the Township for the violation of any provision of this chapter or other applicable ordinances or of any applicable laws of the Commonwealth of Pennsylvania or any rules and regulations promulgated by any agency of the Commonwealth. Upon revocation of a license, the campground shall not be operated until a new application shall be made and granted. Such application shall contain reasonable assurances to prevent further violations of the ordinances or laws or regulations which were violated. The revoked license may be reissued for the remainder of the period for which it was issued upon compliance of the license holder with all conditions for the reissuance. No person shall operate a campground during the time period when a license shall have been revoked. Appeals from the revocation of a license shall be made in accordance with the procedure set forth in ยงย 148-8B.

Any person who violates or permits a violation of this chapter
shall, upon being found liable therefor in a civil enforcement proceeding
commenced by the Township before a Magisterial District Judge, pay
a fine of not less than $600 nor more than $1,000, plus all court
costs, including reasonable attorneys' fees, incurred by the Township
in the enforcement of this chapter. If the defendant neither pays
nor timely appeals the judgment, the Township may enforce the judgment
pursuant to the applicable Rules of Civil Procedure. Each day a violation
exists shall constitute a separate offense. Further, the appropriate
officers or agents of the Township are hereby authorized to seek equitable
relief, including injunction, to enforce compliance herewith.
