It is declared to be unlawful for any person or persons or business
entity to do business in the Township as an itinerant merchant without
first having secured a license therefor, as is herein provided.

Every application for such a license shall set forth the commodities
to be sold, and the place intended to be occupied or used for said
business. At the time of filing of the application, the applicant
must furnish evidence of written consent of the property owner to
use or occupy the site where sales are to be made by the applicant.

The provisions of this article shall not be applicable to recognized
charitable and public service organizations conducting fund-raising
functions.

The fees for such licenses shall be as established from time
to time by resolution by Council for each period of operation of up
to thirty (30) days, which fee shall be in lieu of payment of the
Township mercantile tax.

Where itinerant merchants form part of a show which is organized
and booked by one or more promoters, the promoter or promoters thereof
shall be responsible for the payment of a license fee covering all
such itinerant merchants, which fee per merchant shall be as established
from time to time by resolution by Council for the specific show booked,
and which shall run for a period not to exceed fourteen (14) days.

The owners/lessors of property located within the Township shall
notify the Township of the business name, address/location, occupancy
dates and business purpose of each itinerant merchant on forms provided
by the Township for this purpose. Such notice shall be provided to
the Township not less than fifteen (15) days prior to the commencement
date of occupancy.

Whoever violates the provisions of Article
II, Itinerant Merchants, including the failure to pay the license fee required by Section
16-19, shall, upon conviction before any District Justice, be subject to punishment as provided in Section
1-9 of this Code.
