It is hereby established in the Township of Fairfield a "Joint
Municipal Court" hereafter referred to as "Joint Court" pursuant to
N.J.S.A. 2B:12-1 et seq. with the City of Bridgeton which shall be
known as the "Bridgeton Joint Municipal Court."
The Township Committee of the Township of Fairfield has determined
that it is in the best interest of the Township of Fairfield to establish
a Joint Court by which a desirable economy of scale can be reached
such that, through the provision of joint facilities, joint personnel
and resources and a combination of efforts, a heightened level of
efficiency can be obtained.
The Municipal Court of the City of Bridgeton and Township of
Fairfield will have a seal bearing the name of the Joint Court.
The facility for the Joint Court, including the Courtroom itself,
and the Court Administrative Offices and all Court sessions, shall
be located and conducted at 330 Fayette Street, Bridgeton, New Jersey
08302.
The term of the Joint Court will be established by written agreement
between the City of Bridgeton and the Township of Fairfield.
Effective as of the commencement date for the Municipal Court
for the City of Bridgeton and the Township of Fairfield, as set forth
by written agreement, the respective Municipal Courts of the City
of Bridgeton and the Township of Fairfield shall be abolished and
their powers, duties, functions and pending cases shall be transferred
to the Joint Court established hereunder.
The Municipal Court of the City of Bridgeton and the Township
of Fairfield will have jurisdiction as is now or will hereafter be
conferred upon it by the laws and Court rules of the State of New
Jersey and the practice and procedures of the Joint Court shall be
governed by the laws in such case made and provided in such rules
as the Supreme Court of New Jersey will promulgate and make applicable.
The Joint Court will have one Judge who will be known as the
Judge in the Bridgeton Joint Municipal Court. The Judge will be nominated
and appointed as provided by N.J.S.A. 2B:12-4(b).
The Joint Court shall have a Municipal Court Administrator and
a Deputy Court Administrator to be appointed pursuant to New Jersey
Rules of Court 1:34-2 and such other necessary clerical or other assistants
as agreed upon by the City of Bridgeton and the Township of Fairfield
in accordance with the terms set forth herein and in the underlying
Joint Court Agreement.
Compensation shall be by determination of Bridgeton.
A Joint Court Liaison Committee, hereinafter referred to as
a Joint Court Committee, shall be formed consisting of two representatives
appointed by each of the City of Bridgeton and the Township of Fairfield,
respectively. The Joint Court Committee shall meet twice annually.
The Joint Court Committee shall be responsible to act as liaison between
the Joint Court and the City of Bridgeton and the Township of Fairfield
and act in a policy setting capacity, such as by way of example and
not limitation, the establishment of times for the Joint Court and
such other details regarding the administration of the Joint Court
that do not require action by the governing bodies of the City of
Bridgeton and the Township of Fairfield.
The chapter herein establishes the Bridgeton Joint Municipal
Court. Any written agreement required by state statute and regulation
establishing any of the terms and conditions for the establishment
and operation of the Joint Court is hereby ratified by this chapter
subject to the approval of the Assignment Judge of the Superior Court
of New Jersey for the Vicinage XV and the Administrative Director
of the Courts pursuant to N.J.S.A. 2B:12-1(b).
