A.Â
PERSON
As used in this chapter, the following terms shall have the meanings
indicated:
Includes any natural person, partnership, association, firm
or corporation.
B.Â
In this chapter, the singular shall include the plural, the plural
shall include the singular, and the masculine shall include the feminine
and the neuter.
No person shall operate or conduct any circus or carnival at
any place within the Township of Stowe without first having obtained
a license from the Board of Township Commissioners, as herein required,
and except under all the terms and conditions of this chapter pertaining
thereto.

Application for the license hereby required shall be made to
the Board of Township Commissioners through the Township Secretary.
The Board of Township Commissioners shall have authority, before granting
any such license, to cause an investigation to be made of the proposed
circus or carnival, and the said Board shall have authority to refuse
to grant such license if it shall deem such refusal to be in the interest
of the health, safety, welfare and/or morals of the Township and the
inhabitants thereof. If the Board shall see fit to grant such license,
the applicant shall pay to the Township Secretary, for the use of
the Township, a license fee as established by resolution of the Board
of Commissioners for each day or portion thereof that such circus
or carnival is proposed to be held in the Township, provided the Board
of Township Commissioners may waive the license fee in the case of
any circus or carnival conducted or operated for the sole benefit
of any charitable community betterment, education or religious organization
or corporation.
It shall be unlawful for any person to operate or conduct any
circus or carnival, or to continue to operate or conduct the same,
after the license therefor, issued hereunder, shall have expired,
unless such person shall have applied for, shall have paid the applicable
fee for, and shall have been issued a license for such extended period.
The Board of Township Commissioners shall have authority to
revoke any license issued under this chapter when the Board shall
deem such revocation to be in the interest of the health, safety,
welfare and/or morals of the Township and the inhabitants thereof.
In case of revocation, no part of any license fee required hereunder
shall be refunded.

Any violator of this chapter, upon conviction thereof, shall
be sentenced to pay a fine of not less than $300 and not more than
$3,000 for each and every individual violation, including any costs
of prosecution, and, in default of any payment thereof, may be subject
to imprisonment for not more than 30 days.
