Except as provided in § 150-2 of this article, the Uniform Construction Code, 34 Pa. Code Chapters 401-405, as amended from time to time, is hereby adopted in its entirety and made a part hereof by reference. This article and the provisions hereof shall form and be known as the "Official Building Code of Edgmont Township" and may be referred to as the "Edgmont Township Building Code."
The building code sections set forth in Exhibits A, B, C, and D, attached hereto and made a part hereof, adopted and established by Edgmont Township prior to July 1, 1999, and in effect on the date of adoption of this article, shall replace and supersede their counterpart provisions of the Uniform Construction Code and shall remain in full force so long as each equals or exceeds the requirements of the Uniform Construction Code.
All building code sections or portions thereof not expressly excepted and preserved in § 150-2 of this article shall be deemed amended to conform with the comparable provisions of the Uniform Construction Code.
A. 
Enforcement. Enforcement of the Building Code of Edgmont Township, as adopted hereunder, shall be the responsibility of the Edgmont Township Building Department and Building Code Official, and such other persons as may be established by the Board of Supervisors from time to time by resolution.
B. 
Board of Appeals. The Board of Supervisors shall also establish, by resolution, a Board of Appeals for the purposes and as required by and in conformity with the Uniform Construction Code.
C. 
Fees. Fees assessable by the Edgmont Township for the administration and enforcement of this article and the Uniform Construction Code shall be established by the Board of Supervisors from time to time by resolution.
Violation of this article shall constitute a summary offense and may result in any of the following or any combination thereof:
A. 
Revocation of any issued permit or the denial of any pending permit application.
B. 
Issuance of a stop-work order.
C. 
In addition, any person who violates or permits a violation of this article shall, upon conviction in a summary proceeding brought before a Magisterial District Judge in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense.

A. 
Any ordinances or parts of ordinances, regulations, rules, policies or resolutions of Edgmont Township not expressly governed by the Uniform Construction Code or inconsistent therewith shall remain in full force and effect and be unaffected by this article.
B. 
All ordinances or parts of ordinances, regulations, rules policies or resolutions inconsistent herewith are hereby repealed to the extent of the inconsistency.
