This chapter shall be known as the Building Construction and Fire Prevention Law of the Town of Milo, hereinafter referred to as "this chapter."
A. 
Except as otherwise provided in the Energy Conservation Construction Code of New York State, Multiple Residence Law of New York State and/or New York State Uniform Fire Prevention and Building Code, all buildings, structures, and premises, regardless of use or occupancy, located within the Town of Milo, which are outside the limits of the Village of Penn Yan, are subject to the provisions this chapter.
B. 
Exemption(s):
(1) 
Buildings, structures and premises that are owned by Yates County, New York State or the federal government.
(2) 
Buildings, structures and premises that are owned by a public school district or Board of Cooperative Education Services (BOCES).
(3) 
Buildings, structures and premises that are wholly or partially exempt from the Energy Code, Multiple Residence Law and/or Uniform Code as determined by New York State and/or any other authority having jurisdiction.
This chapter provides for the administration and enforcement of the Energy Conservation Construction Code of New York State, Multiple Residence Law of New York State and New York State Uniform Fire Prevention and Building Code in the Town of Milo. Such state codes establish the minimum requirements to safeguard the public health, safety and general welfare through structural strength, means of egress facilities, stability, sanitation, adequate light and ventilation, energy conservation, and safety to life and property from fire and other hazards attributed to the built environment and to provide safety to fire fighters and emergency responders during emergency operations.
Except as otherwise prescribed by law, every multiple dwelling shall be constructed and maintained in accordance with the applicable requirements of the Multiple Residence Law of New York State as well as the Energy Conservation Construction Code of New York State and/or New York State Uniform Fire Prevention and Building Code. A violation of the Multiple Residence Law of New York State shall constitute a violation of this chapter.
This chapter is adopted pursuant to § 10 of the Municipal Home Rule Law of New York State.
Nothing in this chapter shall be construed as authorizing any authority having jurisdiction responsible for the administration and enforcement of this chapter to do so in a manner that deprives any person or entity of due process of law.
