The Fire Chief or any other officer of any fire department providing firefighting services for a property within this Town, which is outside the Village of Penn Yan, shall notify the Code Enforcement Officer of any fire or explosion involving any structural damage, fuel burning appliance, chimney or gas vent within a reasonable amount of time but no greater than five business days.
Fire safety and property maintenance inspections of buildings and structures shall be inspected or cause to be inspected by the Code Enforcement Officer as prescribed in Part 1203 of 19 NYCRR as currently in effect and as hereafter amended from time to time or any successor rules, regulations or statutes.
In addition to the inspections required by this article, a fire safety and property maintenance inspection of any building or structure may also be performed by the Code Enforcement Officer at any time upon:
A. 
The request for an inspection by the owner or owner's agent; or
B. 
Receipt by the Code Enforcement Officer of a complaint as prescribed in this chapter that alleges violations of any applicable provision of the Energy Code, Multiple Residence Law and/or Uniform Code as well as the Code of Town.
It shall be the duty of the owner or their duly authorized agent to schedule a fire safety and property maintenance inspection with the Code Enforcement Officer. It shall be the duty of the owner or their duly authorized agent to provide access to and means for inspections of the buildings and structures that are required to be inspected by this chapter. It shall be the duty of the owner or their duly authorized agent to accompany the Code Enforcement Officer at the scheduled fire safety and property maintenance inspection.
Nothing in this chapter shall supersede, limit or impair the powers, duties and responsibilities of OFPC and the NYS Fire Administrator under § 156-e of the Executive Law of NYS and § 807-b of the Education Law of NYS as currently in effect and as hereafter amended from time to time or any successor rules, regulations or statutes. Notwithstanding any other provision of this section to the contrary:
A. 
The Code Enforcement Officer shall not perform fire safety and property maintenance inspections of a building or structure which contains an area of public assembly if OFPC performs fire safety and property maintenance inspections of such building or structure at least once every 12 months;
B. 
The Code Enforcement Officer shall not perform fire safety and property maintenance inspections of a building or structure occupied as a dormitory if OFPC performs fire safety and property maintenance inspections of such building or structure at least once every 12 months; and
C. 
The Code Enforcement Officer shall not perform fire safety and property maintenance inspections of a nonresidential building, structure, use or occupancy if OFPC performs fire safety and property maintenance inspections of such nonresidential building, structure, use or occupancy at intervals not exceeding the interval not exceeding once every 36 months.
The Code Enforcement Officer has the right to have a third-party agency/inspector conduct fire safety and property maintenance inspections as prescribed by this chapter to ensure compliance with the Uniform Code.
