No person shall own, harbor or keep in custody any animal which
disturbs, interferes with or otherwise deprives the peace, quiet,
rest or sleep of any person within the Borough of Wesleyville by such
animal making any loud or harsh noise or disturbance. Continuous barking
or howling, or the making of other loud noises by such animal for
more than any one-hour time period or continuous barking, howling
or the making of other loud noises for periods of less than one hour
but more than 1/2 hour, which periods occur on two or more days or
nights in any five-day period, shall be deemed to disturb the peace,
quiet, rest or sleep, or to cause the annoyance and discomfort of
persons of the Borough of Wesleyville.

Any Borough of Wesleyville resident may request the Borough of Wesleyville Police Department (Wesleyville Police Department) to warn any person who owns, harbors or keeps in custody any animal which disturbs the peace, quiet, rest or sleep of any person. Any such request shall identify and specify the residence of the custodian, keeper or owner of the animal. Upon receipt of such request, the Borough of Wesleyville Code Enforcement Officer shall by certified mail notify and warn the custodian, keeper or owner of the said animal of the violation, providing a copy of this Part to that person. A violation of this Part shall be deemed to occur after delivery of this warning and then immediately upon the criteria being as stated in §
2-201 of this Part for all further instances.

Any person who shall violate or fail to comply with any provision
of this Part shall, severally for each and every such violation or
noncompliance, be guilty of a summary offense, punishable by a fine
of not less than $25 or more than $1,000, and costs, or, in default
of payment thereof, shall be subject to imprisonment for a term not
to exceed 30 days. The imposition of a penalty for any violation or
noncompliance shall not excuse the violation or noncompliance or permit
it to continue. Each day that the violation or noncompliance exists
shall constitute a separate offense.
