This article may be hereinafter cited as the "Macedon Trail System Motor Vehicle Law."
It is the intent of this article to enact and authorize regulations that will regulate motor vehicles on the Macedon Trail Systems to the end that such trails may be preserved and enjoyed by the public.
As used in this article, the following terms shall have the meanings indicated:
LAW ENFORCEMENT OFFICER
A police officer, as defined in § 1.20 of the Criminal Procedure Law, a peace officer, as defined in § 2.10 of the Criminal Procedure Law, or any other law enforcement official of the Town of Macedon, the State of New York or any other applicable jurisdiction having jurisdiction or authority to enforce this article.
MACEDON TRAIL SYSTEM
A system of trails depicted and designated as such on a map adopted by the Town Board of the Town of Macedon, and as may be amended, from time to time.
MOTOR VEHICLE
Every vehicle that is propelled by any power other than muscular power, except electrically driven invalid chairs being operated or driven by an invalid and vehicles used for park maintenance or emergency purposes by authorized personnel. "Motor vehicles" shall include, but not be limited to, automobiles, snowmobiles, all-terrain vehicles, four-wheel drive vehicles, vehicles equipped for operation in or on sand, mud, snow, gravel or wetland, dune buggies, motorcycles or minibikes, dirt bikes, golf carts, tractors, lawn mowers or any similar type of vehicle or conveyance.
A. 
Except as provided in Subsection B, no person shall operate a motor vehicle on the Macedon Trail System, except on designated parking areas.
B. 
The Town Board may, by resolution, open trails or portions thereof to designated types of motor vehicles upon terms and conditions it shall deem appropriate.
No person shall fail or refuse to comply with any order relating to the regulation of activities hereunder or the enforcement of provisions of this article lawfully given by any law enforcement officer. Nonobservance of this section shall constitute a violation.
Any law enforcement officer may arrest a person without a warrant for:
A. 
Any offense when he has reasonable cause to believe that such person has committed such offense in his presence.
B. 
A crime, when he has reasonable cause to believe that such person has committed such crime, whether in his presence or otherwise.

Any person convicted of a violation of this article shall be subject to a fine as provided in Chapter 1, General Provisions, Article I.
