A. 
The words and phrases used in this chapter shall for the purpose of this chapter have the meanings respectively ascribed to them by Article I of the Vehicle and Traffic Law of the State of New York.
B. 
The following words and phrases which are not defined by Article 1 of the Vehicle and Traffic Law of the State of New York shall have the meaning respectively ascribed to them in this section for purposes of this chapter.
CURBLINE
The prolongation of the lateral line of a curb or, in the absence of a curb, the lateral boundary line of the roadway.
HAMLET
All areas formerly contained within the Village of Macedon.
HOLIDAYS
New Year's Day, Memorial Day, Independence Day, Labor Day, Veterans Day, State and Federal Election Day, Thanksgiving Day, and Christmas Day shall be considered holidays.
OFFICIAL TIME STANDARD
The time standard which is in current use in this state whenever certain hours are named herein or on traffic control devices.
PUBLIC PARKING LOT
A plot or parcel of land or building owned and/or leased by this village, not including highways, upon or within which the parking of vehicles is regulated by signs and/or parking meters.
The Highway Department, under the direction of the Highway Superintendent, shall install and maintain traffic control devices under the provision of this article to make effective the provisions of said article and shall install and maintain such additional traffic control devices as the Town Board may deem necessary to regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New York subject to the provisions of §§ 1681, 1682, and 1684 of that law.
Thirty miles per hour is hereby established as the maximum speed at which vehicles may proceed on or along highways within the Hamlet except as otherwise provided by law.
A. 
Through highway. Main Street is hereby designated as a through highway and stop signs shall be erected on the following entrances thereto:
(1) 
Erie Street from the north.
(2) 
Erie Street Road from the south.
(3) 
Center Street from the north.
(4) 
West Street from the north.
(5) 
Race Street from the south.
(6) 
Poplar Street from the south.
(7) 
Drumlin Drive from the north.
(8) 
Kemp Drive from the north.
B. 
Stop intersections. The following locations are designated as stop intersections and stop signs shall be erected as indicated:

A. 
Application of article. The provisions of this article shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.
B. 
Parking, standing and stopping restrictions. Parking, standing and stopping restrictions shall apply on the following highways as follows:

Fifteen minute parking shall be observed in front of 81 Main Street

C. 
Parking restrictions on Hamlet street/in Hamlet parking lots.
(1) 
When any vehicle is parked or abandoned on any highway within the Hamlet during a snowstorm, flood, fire or other public emergency, and affects that portion of the highway upon which said vehicle is parked or abandoned, said vehicle may be removed at the owner's expense.
(2) 
When any vehicle is found unattended on any highway within the Hamlet and that vehicle constitutes an obstruction to traffic, said vehicle may be removed at the owner's expense.
(3) 
When any vehicle is parked or abandoned on any highway within the Hamlet where stopping, standing or parking is prohibited, said vehicle may be removed at the owner's expense.
(4) 
No all night parking allowed in municipal parking lots. "All night" is defined as to be all or any portion of the time between the hours of 11:00 p.m. and 7:00 a.m.
D. 
Notice of removal. It shall be the duty of the Police to ascertain the owner of the vehicle or person having some charge, and to inform him/her of the removal and disposition of such vehicle.
A. 
A truck route system, upon which all trucks, tractors and tractor-trailer combinations having a total gross weight in excess of five tons are permitted to travel and operate, shall consist of the following highways:
(1) 
Main Street - Route 31.
(2) 
Route 350/31F.
B. 
All trucks, tractors and tractor-trailer combinations having a total gross weight in excess of five tons are hereby excluded from all highways within the Hamlet except from those highways listed in Subdivision A. However, this exclusion shall not be construed to prevent the delivery or pickup of merchandise or other property along any highway from which such vehicle and combinations are excluded.
The penalties to be imposed, except for parking meter violations, are those set forth in § 1684 of the Vehicle and Traffic Law of the State of New York. Any part or parts of this chapter and any orders, rules and/or regulations adopted and/or issued hereunder which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York shall take effect from and after the day on which approval, in writing, is received from the New York State Department of State.
A. 
In addition to and notwithstanding any other provisions of this article permitting or prohibiting parking, the stopping, standing or parking of vehicles upon any street or portion thereof or public area, except state highways, within the Hamlet may be prohibited by resolution of the Town Board for such period of time as is required, in the opinion of the Town Board, to provide for the safe passage of vehicles, pedestrians and/or emergency vehicles.
B. 
A resolution adopted by the Town Board pursuant to this section shall designate the area, street or portion thereof within which the stopping, standing or parking of vehicles is prohibited and the period of time of such prohibition.
C. 
If a resolution is adopted by the Town Board pursuant to this section, the Town Board shall direct the posting of temporary signs or markings in the area affected in accordance with the applicable provisions of the Vehicle and Traffic Law of the State of New York, and such resolution shall not take effect until signs or markings giving notice thereof are posted.
D. 
Whenever a vehicle is parked on any street or public area within the Hamlet during such time as parking thereon is prohibited pursuant to this section, said vehicle may be removed by or under the direction of any member of the Town of Macedon Police Department, the Wayne County Sheriff Department or the New York State Police department, who shall be on duty.
E. 
Any person who violates a resolution adopted by the Town Board pursuant to this section shall be subject to the penalties as follows: Any person violating any of the provisions of this article shall be punishable for the first or second offense by a fine not to exceed $25 or by imprisonment for not more then 15 days. The third or any subsequent offense within one year shall be punishable by a fine not exceeding $100 or by imprisonment not exceeding six months or both such fine and imprisonment.
F. 
Any vehicle removed pursuant to this section shall be stored or parked in a suitable place at the risk and expense of the owner. Such owner or person lawfully entitled to possession of the vehicle may redeem same upon payment to the Town Clerk of the amount of all expenses incurred in connection with such removal and payment of any charges for storage or parking. The police officer who directed the removal of any such vehicle shall report such removal and disposition of the vehicle to the Police Chief or officer in charge of the Town of Macedon Police Department and also to the Town Clerk, and it shall be the duty of the Police Chief or Officer in Charge to attempt to ascertain the owner of such vehicle or the person lawfully entitled to possession thereof and to use diligent efforts to notify such owner or person of the removal and disposition of such vehicle and of the amount which will be required to redeem same.
