Except as otherwise provided herein, rates for the use of water and charges for installation of additional meters, discontinuance of water service, reestablishment of discontinued water services, penalties and for such other special services shall be as set from time to time by the Town Board.
Any customer may order discontinuance or reinstitution of water service by notifying the Water Department. The Town Board shall by resolution establish fees for discontinuance or reinstitution of water service. The owner of the property shall be responsible for any charges for water consumption up to the final meter reading as well as any charges for discontinuance of service if left unpaid by a customer.
A. 
Except as provided in Subsection B, the customer shall be required to pay a separate and full scale of water charges for each separate use of water on his premises. The following services shall be considered separate uses:
(1) 
Each one-family residence, occupied or unoccupied, which shall include all types of living accommodations, including, but not limited to, studio apartments and mobile homes, and whether in a single structure or part of a single structure shall be designated as a separate use. Each two-family house, apartment or multiple dwelling shall consist of one separate use for each living quarters equipped with separate toilet facilities and separate kitchen or kitchenette. Each other type of residential property, including, but not limited to, hotels, motels, nursing homes, resorts and rooming houses, where each accommodation does not have separate kitchens and toilet facilities, shall be considered one separate use.
(2) 
Each church, library, fire company, municipal building, organizational headquarters, museum or funeral parlor shall be designated as a separate use.
(3) 
Each commercial, industrial or warehouse property, including, but not limited to, retail stores and office buildings, shall be designated as separate uses. If a structure houses more than one separate business, commercial, fraternal, governmental, service or other similar use, each such use shall be designated a separate use, if it maintains water facilities to the practical exclusion of other occupants of the premises.
(4) 
Every school, including, but not limited to, nursery schools, day-care centers and public and parochial schools, shall be designated as a separate use.
B. 
The Town Board may, upon written application, by resolution waive the requirements for separate metering of separate services it the Board finds such requirement to work unnecessary hardship and unusual expense. In such case, the customer shall nevertheless pay in addition to the established gallonage rate the minimum rate for each separate service multiplied by the number of unmetered separate services. All existing services shall be deemed to have the privilege hereby accorded, unless and until the customer or the Water Department shall request a review of facts and circumstances, whereupon the Board shall by resolution make a determination for or against the installation of separate metering.
All water that passes through the meter shall be charged for whether the water is used or wasted. The property owner shall be responsible for water charges or other charges relating to water service pertaining to the property.
A. 
Meters will be read and bills rendered quarterly, the quarter days being approximately the first day of January, April, July and October. All bills are payable at the office of the Town Clerk or authorized agent, and checks must be made payable to the Water Department.
B. 
In default of payment of any bill within 60 days after it is rendered the supply may be shut off and the meter removed without notice. The water service shall not be reestablished, except upon payment of the delinquent bill, together with any additional amount established by the Town Board as a service charge for turning on the water.
C. 
No deduction in the minimum rate shall be allowed for any time less than the full quarter during which water service is discontinued. No allowance in the minimum rate shall be made for more than one quarter.
D. 
Water bills shall be due and payable upon presentation, and, if not paid within 30 days from the date of billing, a penalty of 10% shall be added. Any unpaid water bill on November 1 of any year shall be added to the Town taxes and levied each year and collected and enforced in the same manner and at the same time as provided by law for the collection and enforcement of Town taxes.
In cases where a reading cannot be obtained, an estimated bill will be rendered to the customer based upon average usage in a corresponding period. In the event that a reading cannot be obtained for a period of nine months, the Water Department reserves the right to suspend the water service until such time as accurate billing is made possible through a reading of the meter, and all service charges for suspending and reinstating the water service have been paid to the Town.
If a customer has requested a final reading of his meter or a final reading of the meter plus a discontinuance of service and the Water Department is unable to gain entry to the property for such purpose, an additional service charge will be made. This charge will be effected only after notification of the property owner who is obliged to make the premises available to the Water Department for a final reading. If this is not done, for each additional service call made necessary through the inability of the Water Department to gain entry to a property, a charge will be made as set by the Town Board.
