As used in this article, the following terms shall have the meanings indicated:
AUTHORIZED CITY PERSONNEL
All officials, officers or employees of the City of Passaic entrusted with the enforcement of this Code.
BEDBUG
A bloodsucking bug that is a parasite of birds and mammals.
BEDDING
Any mattress, mattress pad, quilted pad, box spring, foundation, bunk quilt, cushion or couch made in whole or part from new or secondhand fabric, filling material, or other textile product or material and which can be used for sleeping or reclining purposes.
DWELLING UNIT, OWNER, OPERATOR, OCCUPANT, and NUISANCE
Shall have the meanings ascribed to those terms in § 219-4.
EXTERMINATION
The control and elimination of insects, rodents and vermin by exterminating their harborage places; by removing or making inaccessible material that may serve as their food; by poisoning, spraying, fumigating, or trapping; or by other approved means of pest elimination.
INFESTATION
The presence of insects, rodents, vermin or other pests, including, but not limited to, bedbugs, on the premises which constitute a health hazard.
MULTIPLE RENTAL UNIT BUILDING
A building that contains three or more rental units; it does not include a condominium or cooperative building.
PESTICIDE APPLICATOR
Any person who is required to be certified and registered pursuant to the provisions of either N.J.A.C. 7:30-6, Commercial Pesticide Applicators, or N.J.A.C. 7:30-8. Private Pesticide Applicators.
RENTAL UNIT
Any dwelling unit that is not owner-occupied and is held out for rent to tenants, including any single-family home held out for rent to tenants.
Bedbugs are hereby declared to be a public nuisance and are subject to the abatement provisions of this article.
A. 
In any rental unit, or any multiple rental unit building, in which authorized City personnel confirm an infestation of bedbugs following an investigation, it is the responsibility of the property owner to provide pest control services by a licensed pesticide applicator until such time that no evidence of bedbugs can be found on reinspection by authorized City personnel.
B. 
Pest control services shall be provided within 10 days after being notified in writing by authorized City personnel after same has conducted on inspection and confirmed the presence of bedbugs on the premises or in the tenant's rental unit.
C. 
The extermination of bedbugs shall be undertaken by a licensed pesticide applicator only. Extermination of bedbugs shall include the treatment of the dwelling units on either side of the affected dwelling unit as well as the units directly above and below the affected dwelling unit. This pattern of inspection and treatment shall be continued until no further infestation is detected.
A. 
No person shall place, discard or dispose of any bedding, clothing or other materials infested with bedbugs on the public way or in a refuse container or dumpster located on the public way, except when such bedding, clothing or other material is placed in or near the person's refuse container or dumpster for pickup as trash and the bedding, clothing or other material is totally enclosed in a plastic bag or similar enclosure and labeled as being infested with bedbugs.
B. 
No furnishing, bedding, clothing or other material infested with bedbugs shall be recycled.
This article shall be enforced by the Division of Health and the Department of Housing of the City of Passaic.
Any person(s) who is (are) found to be in violation of the provisions of this article shall be subject to the penalties set forth in the general penalty provisions. § 1-3 of the Code of the City of Passaic.
